possible problem , fiancees child's birth certificate says that she is married

Thank you for the responses.Sorry for getting back to this thread so late. My fiancee did get a CENOMAR. She has not been married. The explanation given was that her sisters put a month, year and city of marriage on the birth certificate because the son would not have been able to have the father's surname otherwise.

The child is in his last year of high school and will be going to collage next year , he will not be coming to the US with her anytime soon. Maybe never.

The child will age out at 21 years old so if the mother wants him to join her then she should be sure he is in the USA before then otherwise it will take many years of waiting in line for a slot to become available for him to immigrate.

I have the same case with my son bearing his dad's last name and there was a marriage date on his BC. The consul just asked for additional document from the NSO (221g). The document requested was a marriage certificate between me and my son's dad with the date shown on his BC.

After 2 weeks, both mine and my son's visa were approved and we are both here in AZ now.

Though, I believe it is case to case and depends on the consul who handled the application.

Guess, we were just lucky and I thank the Lord for HIS goodness.

Get the bc corrected if you can because it's SOP to submit a marriage cert to civil registry when the bc is first submitted if the parents were married at the time of birth. I know a lot of hocus pocus happens but the CO may not consider that as the case for your fiancée.

If you can't get it changed in time, bring a CENOMAR. You'll need to bring one anyway so just be sure to get a copy close to the interview date so you can minimize the risk of having to get it authenticated which can be a pain the butt.
