Therein lies the rub. There are several versions of the same events, as reported by the media. We actually do not know which versions, if any, is true.

Korek. And based on the misrepresentations that abound daily in the media, we will most likely NEVER know what is true, from them.

Ordinarily, I would say let the Article 32 process expose the truth. But in light of all the press on this one, I am not so sure that it will be the quickest nor clearest of trials. But typically, military law is just. I guess only time will tell.

In addition to the age old law of war, there's Article 118 of the Geneva Convention to which both Afghanistan and the US are a party.

This is not a declared war, and like it or not (unless the preznit works some more of his illegal 'magic'), the remaining prisoners deemed "hard-liners" will not be released. That's the reality of the situation, contrary to what you posted.

You and i both know politics will prevail and this guy, more than likely will never get a AR32 or General. If the guy is found guilty of desertion etc, it would be bad for the Admin. A lot of good men could have their careers, wiped on this one

When our engagement in Afghanistan ends in two years time, these prisoners of war were due to be released anyways. And again, I ask the same question: If these five characters were such dangerous individuals and we have irrefutable evidence of that then why was not one of them ever brought up on any charges for all these 12-13 years that they were in our captivity? Where are the slam dunk cases against these men? And where is the evidence, case and conviction that Bergdahl was a deserter.

Most of the remaining prisoners - your so-called hard liners - have already been cleared for release. The reality is that not even two handfuls of all the captives that have ever been at Gitmo - nearly 800 in all - have ever been charged with anything. We've had them in captivity for over a decade and have come up absolutely empty in terms of making any charges on them stick. Fact is, we haven't even tried. That just shows how little we have on them. We cannot, should not and will not hold these men captive indefinitely. This whole Gitmo nonsense is nothing but politically motivated hysteria. It's a stain on the fabric of this nation, it's a violation of the very values this nation once held near and dear.

Over and over, each detainee received a “recommendation for continued detention” by a military board at Guantanamo.

It's not outside the realm of possibility that the preznit will again break the law, do another "end-around" past Congresss, go against all recommendations of those in the know, and free more terrorists. I wouldn't put it past him....

According to this story, 80-90 of the preznit's staffers were aware of the exchange, while Congress was kept in the dark. Nice show of "transparency", eh? <_<

And now the preznit is throwing Chuck Hagel under the bus, saying it was ultimately his decision.

They should really coordinate their lies before they start telling obvious whoppers in public. :rofl:

I'm not even asking for any convictions just the charges that have been brought against them? Let's hear it.
