I can't imagine where you got that idea, but it's not correct.

In addition to the age old law of war, there's Article 118 of the Geneva Convention to which both Afghanistan and the US are a party. I know that Republicans in the House and Senate will be hell bent on not honoring commitments this country has made but that doesn't necessarily mean that those commitments won't be honored. Sure, there are loopholes but that doesn't mean we should use them. Aside from the five recently released, there are about 80 more prisoners who have already been cleared for release. There's no benefit to be had from keeping them indefinitely. One day, we will all realize that. I already have.

The law (that Obama signed himself by the way) is that congress must be notified 30 days in advance when any prisoners are released from Gitmo.

Ideas, not facts. I served with the Army as well. If he deserted, he should be brought back and face trial. Don't recall reading in the UCMJ that we just leave soldiers over there when they leave their post.

"The law" is an intricate thing and can be played out so many ways in court. Fascinating!
