Hi everyone!

So my question has to do with driving with an expired visa. My husband just received his NOA1 for his green card last week but his K1 visa just expired today. Will he have to wait until he gets his EAD card to drive again or can he still drive as long as he is carrying his NOA1? He currently has a International driver's license.

Most states require you to get that state's drivers license within 30 days if you move into that state. They also often require you have at least the EAD before you can get that license. Odds are your husband has been driving without a valid license for a while.

Timeline

Some states like TX will allow you to drive on Internation DL for 1 year from the date of arrival. That should give you enough time to get the EAD card and apply for a state side DL. I would go check with your local DMV and always keep a copy of the I797c with him/her to prove legal residence.

for a start the K1 expires on entry to the US, that is to say the day he got to the US. You need to check with your local DMV, he will be considered resident not a visitor now I believe.

MD lets you drive for 60 days other states are different, so you need to check with them.

Looking at your timeline it seems like his I94 has expired as well so he probably will not be able to drive until he gets his EAD and does whatever driving test he needs to do in FL.

Check with local DMV.
