Thank you for all your answers. As for kidnapping, my husband does not mind us leaving. He just does not want to do anything to help us to leave.

As for kidnapping again, guys I don't even have a car to cross the border of the state. Husband does not have money to pay the expenses like lawyer, plane ticket or passports for baby. This is why he never filed adjustment paperwork for me.

Calling police, this is what I am scared about. Even if I call shelter, police will be involved soon. I need to be sure they do not take my baby away from me. Does anybody know what is going to happen after I am brought to the shelter.

As for lawyers, I cannot afford them unfortunately. If I had money for lawyer, I think I would not be here on this forum right now.. But thank you anyways!

In the state of Texas one can be divorced in 8 wks

If do not own property together or kids

They do DNA to acertain if the husband is biological father.

If the small town is in proximity of larger cities Dallas Houston San Antone Austin U can

call a shelter they'll pick U up, you also may have a Vawa case because he has U locked

in & so far have not filed any papers on your behalf.

Your child is USC by birth....get his name removed so U get a form that single

parents are given to get a child PP...once verified he is not the dad

The longer U stay in the situation is the worst it gets, Get help asap, pack U &

baby stuff-all papers to make sure U leave nothing behind

Why would the police take your child away from you?

I do not know, that is what my husband keeps telling me. He says as soon as police finds out I am not adjusted with an expired authorized stay, they will take my kid away and deport me .. To be quite honest, this freaks me out.

Well we do not have big property together, just small like furniture or household stuff. So yes on the paper we do have a child. And so I think our divorce will take at least two months. Not to mention cooling off period (not likely to happen but who knows)

Maybe I am missing something, but you came over here on a Tourist Visa? How long is the tourist VISA and how long is the overstay? You could be subject to deportation automatically if your Tourist VISA is expired, regardless if you are married or not as he has not filed anything for you in regards to becoming a lawful resident of the US. If it expired a long time ago, you will definitely have a ban from entering the US for quite some time, so that could affect the status of your child (or ever seeing your child) since your child would need a passport to travel but does not have one.

This could be a fragile situation. Being that you are not in the US legally anymore and there is no process in action to have you become one, you will need to take this into account when deciding what you want to do.

call 911 they will help you .tell the situation.where you from?

911 is not the best idea, if she has over stayed her time , they will run her name etc and since the husband is on the kid birthcertificate, they will hold her in central booking and put the kid in social care till the next morning until they can find out her statues. If the husband is accused of anything he can say she is illegal then central booking will transfer the case to INS, which will take a few weeks while she is in holding, if she cant prove the father is abusing the kid, thats where they will release the kid to his custody and assign a social worker to make checks. a shelter is her best beat and pro bono lawyer to help. If she can prove abuse in anyway , the court will be very understanding but the burden of proof she has to prove, agaisnt the husband.

My only comment after reading this is wow what kind of mess we get oursleves into, been there and done that and fortunately I have learned to make better choices and not be so desperate when choosing a possible mate, someone to spend my life with, I encourage you to start making good choices as the husband sounds like a real piece of work.

Best of luck to you and your children! Do whatever you need to do to protect your children.

She can't get a passport without her spouse's (on the child's birth certificate so he is legally the father) cooperation. Then she would need his permission to take the child out of the US. A divorce or paternity testing with a court order finding her husband to not be the child's father is the only way out of this.
