His I-130 was approved July 12 2013. But we took nearly one year to pay the AOSand IV fees and FINALLY managed to pay them on June 5! I understand the next steps are to establish support. THIS is where the problem lies... When we filed the I-130, I HAD an income and a bank account- but I've been stuckhere with him 8000miles fromhome and since we fled the I130 abroad,I have lost my income AND my bank account too. We DO have a joint sponsor and should be fine with the income limitsthat way. But when does the joint sponsor submit the I864/864A? And Do I (the spouse petitioner) just give my husband the I864 for MY primary sponsorship to take with him to his interview?
After we paid the AOS and IV fees, is he waiting now for his interview date???
To be honest, I'm not even sure if he's getting the K3 or the IR-1! it seems like the IR-1 to me... because I didn't file the I 129f with the I-130...
If I'm not mistaken, we should be close to going home yes??

WOW you have alot to know about what you need to do. Please read this NVC process wiki so you know what to do left.

You still have alot of processing to do. Do you have your last 3 years taxes filed? That is required of you unless you didn't have to file (didn't work or make enough to file)

And no you are not chasing a K3. If you didn't file a I-129F there is no K3 to even chase.

Well you are closer but hold on you have still about another months at NVC you said you paid but haven't done anything. Please read the wiki attached.

Interview will be scheduled once you have case complete you are put in interview queue when your turn comes you will be scheduled expect 1 to 2 months after case complete.

so realistically you are looking at another 4 months depending how long it takes you two to get your paperwork together seems like you missed that part.

Thanks for the tips and the guide!

1. The paperwork part- you mean the AOSpaperwork??

We're not to that point yet because it said the NVC will send the I-864 and the I-864A to my address in PA, which we have not received since we only paid the AOS/IV fees on THE 5th of June. I'm in Pakistan withmy husband now (have been for 5 years) and I didn't work because I was disabled- needless to say they stopped my disability benefits as soon as I told them I was outside of the country- my bank account overdrafted and closed as well. so, technically, I do not have nor can I get taxdocuments for 3 years or have any proof of income at the moment. But my joint sponsor (my roommate in US) has all of that! She should send the I-864 to the NVC in US correct? and MY I864 should go to the interview with him? Not sure I understand this part correctly.
2. After she sends in the AOS documentsfrom her side- THEN the interview???
3. Do we pay the $165 BEFORE we go to US or can we pay it AFTER we go? (assuming we DO go)

You need to submit BOTH AOS and IV documents as soon as their respective fees become available on the CEAC portal. Both packages can be sent from overseas.

Your AOS package would include your I-1864 and that of the joint sponsor as well. It should go to NVC as one package.

the AOS and IV can be sent seperately - many people do that due to timing issues.

Other folk send them together.

Regardless of when/how you send it in - must include the coversheets that you are downloading from the payment portal.

as to your I-864 questions:

1. ALL I-864 stuff must be submitted together - you and your co-sponsers must go in the same packet. Suggest a cover letter listing all items.

2. Doc intake occurs at NVC. If a tax year has passed between filing at NVC to interview day (ie - it's now 17 April 2015 for interview day) then an updated set (on both of you) of I-864 stuff MUST be handed over on interview day. Otherwise - the stuff sent to NVC is used for adjudication at the IV Unit - no need to send again to have in his hand.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
