INFOPASS and Strange Letter

Timeline

I was in AP for 17 months after my interview in Naples for my green card through my wife.
We scheduled an appointment with INFOPASS to know whats going on, after she went to the appointment they asked her for the "A" # which she didn't have but instead she gave them the EAC number. The officer said we would receive a letter within 2 weeks. this is the letter:


"On May 20, 2014, you appeared at this office and requested the status of your Form I-130. Service records indicate that your Form I-130 was approved on December 21, 2011. As per your request on the Form I-130 the application was sent to the NVC for Consular Processing. Therefore, if you would now like your petition to be forwarded to the district office, so that your spouse may adjust his status in the US, you must file Form I-824."

Its very strange because when I check the case status online on USCIS website it says they are reviewing our case and if its reaffirmed or they need something from me they will let me know.

We also already filed an I-824 at the beginning of this very hard journey.

Whats going on?

The case is at the USCIS because when checking the status online it says "a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you."

So my case was sent back to USCIS... but its strange because why would the USCIS send me such letter if they are reviewing my case?

I think you may be somewhat confused about these forms. Why would anyone file the 824 at the beginning? see the following from USCIS.

The purpose of Form I-824 is to request further action on a previously approved petition or application.

Form I-824 may be filed for the following reasons:

1.To request a duplicate of the approval notice originally issued by the Service Center because the original notice was lost, or incorrect information was provided to the Service Center.

2.To request that a U.S. consulate or port of entry be notified of a petition/application approved by the Service Center (when consulate notification was not requested in the original filing).

3.To request that a different U.S consulate or port of entry be notified of a petition/application approved by the Service Center (other than the one listed on the original filing).

4.To request that a U.S. consulate be notified that status has been adjusted to permanent residence (if the adjustment application was approved by the Service Center).

Had my interview in Italy, was put in AP and they sent the case back to USCIS.. after 17 months and after many calls we decided to try INFOPASS.. and that it the letter we received.. I am outside the United States and I can't even enter the US at this point, at least this is what the officer said.

Had my interview in Italy, was put in AP and they sent the case back to USCIS.. after 17 months and after many calls we decided to try INFOPASS.. and that it the letter we received.. I am outside the United States and I can't even enter the US at this point, at least this is what the officer said.

This reminds me of my own case but even that didn't take this long. I suggest the USC contact a politician asap. They can be found on line. A U S Senator for example will have a staff member that does this type of work. In my own case they didn't help but I have seen cases where they do. They all have a form that must be sent in to begin the process of them assisting the USC in these cases.
