Hi everyone,I am here again with my question .My friend has got married with her foreign fiance . After marriage she has changed her last name in social security.

Now her husband is about to apply green card . Question is that what last name should be used in form I-864 ? Because in income tax return she use her old one.Please reply me as soon as possible.

If they changed their name when they got married, then they use the new married name for everything after the wedding. The copy of the marriage certificate sent with the AOS paperwork acts a legal name change document. It does not matter that the maiden name was on past tax returns. The maiden name had to be on the past returns because they were not married yet when the taxes were filed.

And just to clarify, if she took her husband's name, then that is her legal name from the day she got married, not when she she got a new SS card. She can use her new name from the day she got married. The social security administration does not do legal name changes. All that is needed is the marriage certificate to prove her new name, even if her new name is not actually on the marriage certificate.

Use her current legal name... married name.
