filed single and married on AOS

Just reading on the faqs on here can't file single when married. Which have filed 2013 taxes already and turned in AOS husband interview is in 3 weeks should I try to amend return. Husband doesn't have social security number so tax preparer filed me as single. Has anyone ran into trouble by doing this

If you're married then you don't magically become single by your spouse not having a social security number.

Your tax filing status is determined by your marital status on 31st December of the previous year. If you were married on 31st December 2013 then your filing status for the 2013 tax year is either "married filing jointly" or "married filing separately".

If you incorrectly filed as single when you were married then expect problems.

When I sent my AOS to nvc they didn't have a problem with it everything is actually at the consulate now

Hi you have to amend your taxes cuz your married lucky nvc didn't catch that but the embassy might, when I did mine first I had to file a W-7 form then the IRS does your taxes for the first time but good luck

Its not NVC's call to check and determine your filing status. They are a document gathering center prepping you for interview.

Depending on the CO the embassy its a toss up if they will let it slide or not.

No you won;t get denied but get a 221g to amend your taxes which will delay you some weeks or months.

If you amend now and at least have the copy they may let it slide or make you wait until IRS logs it and you have a new tax transcript which will be a good 2 to 3 months later.

I have ready a couple of people in the last few weeks have interviews and they have to amend because of that. So I would lean to good judgement and amen now.
