I am married to a USC and have a conditional GC. We want to petition my minor children. Which form do we fill out? What are the requirements? Fees? I would be the petitioner, right? I read the link but mostly definition of terms. I want to make sure we did it right. Thanks in advance!

You can petition for your children, however, considering you're a LPR and not a citizen, it would be much faster if your spouse were the petitioner. Submit an I-130 Petition for each child, the fee is $420.00 per petition and $88.00 for the Affidavit of Support.

If filing multiple petitions at once, only one $88.00 Affidavit of Support fee is required.

stepfather. with the i130 you send in copy of your marriage certificate to prove that he is the stepfather. He could have filed for all of you at the same time

read the guides. As long as the marriage took place before they were 18, he can file for them.

Thanks for the info! I didn't realize he actually could be the petitioner. My daughter will turn 20 this month. Isn't she still considered a minor child. I read it's 21 and below.

if you were married when you child was 18 or over, then he cannot file for them. Maybe for the ones who were under 18 at that time

you would need to file for her then and you should have done that as soon as you got your GC because it can take 2 years and she will have turned 21. Hopefully she will have her interview as a minor. I hope she can adjust under CSPA, being a minor and not to have to wait for years.

How old were they when you married your USC?

Hi,

My daughter is turning 20 this month. My son is turning 18 in September.

At the time of marriage, daughter was 18, son was 15.

I came on a B1/B2. We got married in 2012. I have conditional GC.

Did you arrive on a K-1?

Your husband can't file for her but he can file for your son.

You file for your daughter. She'll be under the F2A category (1 year or more wait) provided she doesn't age out or else she'll be transferred to the F2B category (10yr wait).

Oh wow! Can we send both petitions in 1 packet? Does this mean 2 separate affidavits b of support? Thanks a lot for the info.

There will be two separate case files, because the petition submissions will be two different types.
