Hello.

My girlfriend went to New York exactly 2 months ago. Her family (2 sisters and her mother) went there about a couple of weeks before her.

After about 3-4 weeks, her family received their GreenCard. But its been 2 months since my girlfriend got to the USA and she hasnt received anything yet.

However, she got an appoinment from the USCI asking for her finger prints. Shes in the F4 category. This is what she got when she asked at their website:

Your OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION was accepted and is being processed at our intake processing center. On May 2, 2014, we mailed you a notice explaining this and describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

Her ticket to Peru is planned for june 18th. We are planning to get married so she can pass me the Greencard, but as you can imagine, if she hasnt received the GC until now, theres no point in getting married.

Im wondering whats with this delay, she said that shes pretty sure that she will get the greencard, however we dont know when this will happen.

Any ideas?

Thanks

She will not need the physical green card for travel or to get married to anyone. When she entered the U.S. her passport should have been stamped with proof of temporary evidence. A I-551 Stamp. The stamp is valid for one year which is valid to depart and enter the US and even to submit any paperwork to USCIS and it be accepted as proof of RESIDENCY.

So that means that she can come back on june 18th and get married? She told me that she called to something with a name like Infopass, and that she will get an appointment for that. Her fears that if she returns and gets married she will lose her resident status because she still dont have the physical greencard.

Hello goombario,

Infopass means she made an appointment to speak to an immigration officer. At this appointment, she can ask the status of her GC and whether there are any issues that may prevent her from traveling outside the US and later return.

Like RICARDO4EVA2 said, she should be able to travel with the stamp on her passport. However, if she has any doubts regarding her visa status, she would want to be 100%. The officer at the infopass appt. should be able to confirm and clear her doubts.

Good luck!

Thanks for you answer. I saw your timeline and the first part kinda rememeber myself and my gf. Im pretty worried about this, because we have a date for the wedding but she insists that she needs the gc before getting married. We are now living separately, Im still here in Lima.

You mean the part about meeting in high school? That was such a plot twist for us, to meet each other again and fall in love after all those years, lol!

Your girlfriend's issue is not whether she can get married or not. The real issue is to be 100% sure her GC process is complete and she is free to travel back to Peru and return to the US without problems. When is her infopass appointment?

On June 17th, and her flight back to Lima was programmed for the 18th...
