Timeline

Hello all,

I had a question about the Affidavit of Support. I will most likely be living in the UK with my fiance until his visa comes (fingers crossed), so I will not have a job in the US.

My mother is going to be our co-sponsor and she makes more than enough for a household of 4 (Me, her, my sister and my fiance) based on the poverty guidelines.

I'm worried, however, that it will not be good enough. I will be a student when I return and I'm sure I will be working as soon as we get to the US.

Has anyone been through this before? I read in the guides that there are cases where no matter how many co-sponsors you have, you may be denied if you, the primary sponsor, is not working. However, I think in the case they listed, the person was on goverment benefits, which I have never been and am not currently on.

Kinsey,

Unless your mother shows you as a dependent on her tax returns she is not financially responsible for you.

For the visa you do not have to sponsor your fiance, your mother can be his sponsor. For his adjustment of status you will have to be his Sponsor, and if at that time you do not have sufficient financial resources to qualify alone you can either

- use your mother as a Joint Sponsor, or

- use your mother as a Household Member if you and your husband are living in the same residence as her.
