hello so I'm new to this my fiance and I are trying to get married but he's an immigrant he didn't know he was an immigrant until he was 18 when he tried to go to college and has his mom for social number that's what she told himthat he was an immigrant he said of all his money to contact a lawyer to get his papers and started the process about 2 years ago the lawyer told him he needed two years of workers permit what his first payment was due to expire his lawyer just packed up and left left no forwarding information no address no nothing sadly we do not have the money to hire another lawyer to help us and we really want to get married I'm a citizen but we don't know what paperwork we need to fill out we're trying to avoid having him go to Mexico because there's no family no nothing there for him he would end up living on the streets and I would have no way to contact him do something please help us we don't know what to do little people to fill out and everywhere we try to talk to you every one of them says something different thank you

I think you should check this out if I understand your situation and that your fiancé was brought here as a child and either his parents overstayed with him or they came here illegal or something similar to that. This is what you need to check out. I assume since he doesn't remember living anywhere else that he was here before he was 16.

I would apply for this, then once it is approved, get married, and file I-130.

yeah he's an illegal and that's what we're trying to find out is what paperwork or forms we need to submit so we can get married and help him get a citizenship we're trying to do this on our own because we don't have money for lawyer fees and the forms to and he's been here since he was 2

Okay, really you best option is to contact an immigration lawyer, but if you don't have enough money consider looking for one who does pro-bono work in your area. The link that I shared above is one option to staying here, but really what you need to do is contact a lawyer. Does your fiancé have a driver's license? Or other necessary forms to get married, because getting married and filing form I-130 and I-485 will allow him to be here until approval or denial and can suspend current deportation proceedings, but it's really all dependent of who gets his paperwork and what his exact situation is. So again, you really really really need t speak to a lawyer. I'd recommend writing up a letter explaining your situation and calling local law offices that specialize in immigration and ask them if they would consider doing your case pro-bono. good luck

Even if you do not have the money to pay for a Lawyer for the whole process at least have a consultation to see what you are up against.

www.immigrate2us.net has a good list of recommended lawyers.

Just as a note your fiance is not an immigrant. He is an illegal alien in the eyes of the law.

Check out the DACA (Deferred Action for Childhood Arrivals) and after you guys get that sorted out, then worry about getting married. I do not think you can adjust his status as he doesn't have one unless he did enter legally originally. He won't be a citizen for a good long while yet, but he can hopefully become a legal permanent resident.
