Petitioner stops working in the time making K1visa

Dear All,

I am waitting NOA2 now ( NOA1 came in Apr/24), and my receipt number starts with SRC.... means we are in TCS . In the time we applied K1 visa, he still works. But he stopped working 2 weeks before . I am worrying when USCIS is going to check his background, they found it. Is the anyone got the same status with this. And does it affect our K1 visa? Please help...

2014/04/23: Noa1.

2014/10/15: NOA2

2014/11/14: casenumber

2015/01/15: interview

2015/01/27: visa inhand

2015/02/27: enter US.

2015/03/01: got married license

It will not affect the petition right now but it will affect in the future.

When your petition is at US Consulate, he needs to provide recent paychecks to prove his income for I-134 if he is your sponsor. You can either have him or other co-sponsors to provide the support documents for I-134. Note that US Consulate is hardly accepted co-sponsor in VietNam. However, I recently heard some people can get away from it.

This is a statement from US Consulate in Vietnam" The officer will determine whether accepting co-sponsor at the interview day".

I would recommend him to find other jobs in the meantime.

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

When I applied K1 visa, I also applied I-134 together with his taxes document in 2010, 2012 and 2013. And in my forecast, around this September my I-129F will be approved, and it will be came to Viet Nam around Nov, then I will have interview in Dec or Jan. May be until that time, we don't need to show US consulate 2014 taxes.

And by the way, he was manager in big supermarket before. he has much experiences ( > 10 years) , he can find out job easily in soonest. Thanks anyway.

You dont need I-134, letter of employment / paychecks, and tax transcripts until your interview day. If your interview date is before 4/15/2015, then you might not need tax transcripts for 2014. However, he needs to show that he has stable income to sponsor you which I indicate above ( paychecks or letter of employment).

You dont need I-134, letter of employment / paychecks, and tax transcripts until your interview day. If your interview date is before 4/15/2015, then you might not need tax transcripts for 2014. However, he needs to show that he has stable income to sponsor you which I indicate above ( paychecks or letter of employment).

How about, Do I need to make one new I-134 to show them which I applied together with I-129F.

April 15 is the deadline to fill income tax for 2014 so they are most likely not asking you to provide tax2014. Yes, your fiancee needs to give you tax transcripts 2011,2012,and 2013 with paychecks or letter of employmen. It is better if he can give both paychecks and letter of employment.

You dont need to submit I-134 in the package I-129F. I-134 is required at interview day in Vietnam.

An updated I-134 and W2's and an employment letter would be needed to show USC employment status.

You already submitted a I-134 so they may or may not ask for an updated one.

I am sure they will ask for W2's and employment letter though.

2014 taxes only if your interview is held after April 15, 2015.

Ebunoluwa is correct. All is required is the previous year of taxes. There is no need for the past 3 years. Here is more information of what is required.

Evidence of Support: The petitioner must submit a complete original signed Form I-134, Affidavit of Support for his/her principal beneficiary and one copy for each accompanying beneficiary. The original form I-134 must be accompanied by records of the petitioner’s income for the most recent tax year.
