Hello guys !

I am a new fellow visa journey user. I've been reading and I've found quite the help in the site.. though now I'm in a predicament. My girl, living in the U.S (I live in Colombia) is only 21 (I am 24) and her job doesn't provide enough money. She roughly makes 19000$ yearly, short of the 125% guideline for a few hundred dollars, she also owns a car, which you could place as asset between 20000$ or 15000$ dollars.

Does she have enough to NOT need a co sponsor ? thank you everyone and I'd appreciate every piece of advice and info you can give me. Remember, the consulate for the interview will be Bogota-Colombia and the interview will be scheduled hopefully in the next few days.

I assume you are applying to K-1 visa. If that is case the k-1 visa uses the i-134 form for affidavit of support, which is based on the 100% poverty line. Additionally there are some specific requirements and/or supporting documentation applicable to the I-134 that you may want to review prior to the interview.

the I-134 is adjudicated using I-864P document.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I assume you are applying to K-1 visa. If that is case the k-1 visa uses the i-134 form for affidavit of support, which is based on the 100% poverty line. Additionally there are some specific requirements and/or supporting documentation applicable to the I-134 that you may want to review prior to the interview.

I do am applying for the K1 visa, it's already in the mail towards Bogota for a few days. Now that I've been checking everything I need, I came to this issue, and I'm scared she doesn't earn enough money :/ do you think we should apply for a co sponsor ? (There's one possibly available) Do you have any tips or advice you can give me regarding to the subject ? She earns short of 19000 yearly, and she's got her car, which is probably worth 15000$, she's 21, I'm 24, and she's had her job for about a year, she also has 1000$ in saving account.

Car is irrelevant.

I would get a co sponsor, if in doubt it is simply easier.

Well, she will need assets to cover the difference at a rate of 5 times the amount, so let's say she is $200 short, then she will need $1000 in assets.

A primary car can be a tricky asset. Does she have a loan on it? I wouldn't count on it being considered.

How short of $19662 is she?

Can she pick up a quick side job or find a co-sponsor?

You won't be denied at the interview for failing to meet the income requirements, but you will probably be given paperwork that says something to the order of meet the financial requirements and we will issue the visa (that is if there are no other issues).

You guys are being really helpful !

Okay, let's say we leave the car and the second job aside. There's a person which earns well enough to sponsor me. That is... my mother's husband. My mother's been on the US for about three years, she came there for the same K1 visa, she's still married to him and she's got a Job (My mother earns around the same as my fiancée, nonetheless, he earns around 100k yearly. Is he a good choice for co sponsoring ? It would be the only option to me.

Alrighty then ! I suppose then, that leaving aside everything, the co sponsor would be the best idea. Is there anything bad of that co sponsor, having sponsored someone else before ? and that someone else, my mother ! xDD and for the same K1 visa that I myself am applying now ?

is used for the I-134.... suggest you have a look - nowish - as the Vice-Consuls worldwide use it.

Many consulates use the guidelines for the I-864, even for the I-134 for a K-1 visa. This is because the K-1 is a special non-immigrant visa because it does in fact have immigration intent, and the I-864 will be needed soon after entering the US with the K-1 visa. Even if a consulate accepts the 100% income, how does that help them when it is time to file for AOS and the I-864. They cannot get around needing the 125% at some point. They will need enough income and/or assets, or they will need a co/joint sponsor.

Yes, leave the car out of it because an only vehicle cannot be used as an asset. She would need more than one car in order to use the net value of one. Also, does not seem there is enough time for the second job route.

The co-sponsor can sponsor as many people as their income will allow. If they make a 100k a year, then there is no problem with their income meeting that of their household size plus you. If he i willing, have him fill out an I-134 and provide the supporting documentation to go along with it. Since he sponsored your mother, he should already know what he needs.
