So, the USCIS is processing the petitions received by January 19th, 2006. What happens to people who applied in December and still has not gotten a response?? should we just keep on waiting?? or should we make an infopass and go find out what the heck is going on with our petitions?

I know I have been a royal pain with this. But I have a job waiting for the EAD, Im running out of money, and frankly, I am bored of being at home and doing nothing all day long!!!.

Advices are welcomed....

PS: By the way, I thought I was entitled to a walk in EAD after 90 days of my NOA (March 23rd). I was checking my profile, and it says that I might receive my EAD on April 8th? is this counted from the biometrics??

Infopass time! After 90 days, you can ask for an interim EAD.

My wife and I submitted our I-485 and I-765 applications on Nov. 8, 2005 and USCIS acknowledged receipt on Nov. 14. We got an appt. for biometrics for Feb 28, which we went to in York, PA last week. Today I got an email that the EAD was approved. They took biometrics for both the AOS and EAD, so I think that is why ours took more than 90 days, but I don't mind because we got both biometrics done in one trip.

sounds like you should call or go to your local office for an infopass on March 23rd. There they can issue your interim EAD as the 90 days are over.

Good luck

90 days is since receipt by USCIS, not NOA date. Receipt date is about a week ahead of NOA date and is also shown on NOA. Go by the receipt date, and you may get EAD a bit sooner!

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Well... what concerns me also, is that we havent had any touches, I mean, we had our biometrics for AOS and EAD on February 7th, we had a RFE and we replied to that (receipt of RFE dated on January 26th). The AOS petition was touched (because of the RFE in January) but nor my EAD or AP have been touched at all.... and I have no AOS interview letter at all!! I see that most of you got it already.... I am freaking out now!!!

Schedule an Infopass appointment for March 23rd (so it's 90 days over) today. If you get your EAD before that date, simply cancel the appointment and if not...then you already have the appointment set up. I hope you hear something soon :)

You haven't been skipped, but you may be waiting on something.

Keep in mind that "processing" does not mean "processing has been completed" - if applications received prior to January 19th are now in processing, then your application submitted in December is in processing.
