Please guys advise, how can I bring my son to US?

Hey everybody,

I came to US on IR1 visa 2 months ago, I have 12 y.o. son in my country. What is the right way to apply for my son?

1. Should my USC husband apply as for his step-son or

2. Should I a LPR (green card holder) apply for my son?

Should I search about K-4 type visa or IR type?

Please share your experience

If you came on the Ir visa there is no K for your child you have to use the IR path. Your husband should file as it is faster by years. He will file an I130 package almost identical to the one he used for you. The bio dad if involved in the child's life must sign a statement they allow the child to immigrate. Make sure you know what is needed for this early on. If you need the court to grant you sole custody it might take a few. This is specific to the rules in your country about sole custody, Your sons process will be like your, petition, medical , interview.

This will not be over quickly. You will not enjoy this.

I suggest option #1.
