Hi,

I am a green card holder and due to security I cannot visite the country where is my wife at. I married to her 2 years now and I was not present in the day of marriage but my relatives sign the marriage certificate on my behalf and I have witness as well.

is this would be enough evidence for me to apply I-130 or k1-k3 for her.

There is anybody experience this. Please advise.

One of the requirements for a marriage for immigration purposes is that the marriage has been consummated. That means the two of you had sex. Now, you don't need to provide proof that you had sex with her but if you have not physically been in the same location as her since the marriage it would, of course, have been impossible. Thus the two of you must physically meet somewhere, anywhere for at least a few minutes. Again, they don't want proof you had sex but that the two of you were in the same place at the same time. Until you can prove this you are not married in the eyes of immigration.

You must be unmarried and a US citizen to file an I-129F petition for a K-1 fiance(e) visa.
