A few months where the foreign fiancee (now spouse) can't work has to be expected for the K1. It sucks, but unfortunately, them's the breaks. We don't look forward to it, either, but I'm trying to save now to plan ahead the best we can.

You're right, Tracy. A few months without being able to work should be expected. Unfortunately, some are finding the wait can be 8 - 12 months.

I don't think it should be expected that you have to give up your job every year either, because they don't get the renewal out to you before the previous one expires.

Those that are awaiting AOS, with processing delays now for just about everything (particularly background/name checks) it seems to be becoming more common that applicants are suffering more problems with employment authorization.

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!

Matt - when did you file your AOS and EAD? Was it around Nov sometime (just guessing since I can see that's when you made posts about stuff being returned, etc)? If the full 90 days hasn't passed yet there isn't much you can do, they will just tell you to wait. If it has passed you can try making infopass for the EAD, but as far as the AOS goes that just requires a lot of patience from you. We filed at the end of July and got one of those "lucky" CSC transfers in October but as of yet aren't approved, although most who get transferred get approved quickly (not complaining, just saying CSC isn't always an instant approval but we are ready and trying to be patient). The EAD is really the only thing you can do much on provided the 90 days has passed but there are no guarantees.

Yes, sorry, I thought I made that clear. My bad. We DID file for the I-765 (same time as AOS) and received the letter stating the form had been received. Since then nothing. When I called two weeks ago to enquire I was told that Anh might not get approval on that until after AOS, which sounds completely insane to me since AOS could take, as you say, months or years. How can the government force her to stay here at home and do nothing?!

We are really worried and poor Anh is getting more and more depressed. She has always worked since graduating (and all through college) and feels useless. She also feels remendous guilt that she cannot send a little money home each month. I have sent some, but I cannot just hand over my paycheck. We have bills to pay, she knows that and has not asked for anything.

Lunar New Year is coming up and she hoped to be able to send her parents a little bit of money for them to celebrate and now she cannot because of the inability to work. This sort of situation is not good for married life. It does put a strain on us and I have had to have tremendous amounts of patience and understanding with her about this.

This is just horrible, folks. :(

Sorry to hear that, i have just written in another thread, wondering if it's sooo necessary to put such pressure on families...it's quite beyound my understanding...I have an idea..maybe too thin, but...What about getting an Infopass appt to plead for work temp permit or ask whatever is possible permission to work they can provide...

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.
