Marital Status for NBI clearance? Divorced abroad, K-1 Visa

Hello,

We are confused my Financee (Filipina) was divorced overseas and needs an NBI clearance for the K-1 Visa. She was married to a Filipino so is still legally married in the Philippines because she has not yet processed her Annulment. (she is not Muslim so divorce is not an option for her in Philippines) The form for the NBI clearance asks marital status, she is applying for the clearance from overseas. How should she complete this form as to marital status without causing problems in her K-1 Interview?

Does she have a court copy (certified) of the divorce decree? Will she interview outside of the Philippines? If so the divorce will be recognized.

Answer the question on the NBI form truthfully.

Hi!!! She is not yet annulled? Therefore shes still married to her ex husband. Then on her NBI, shes married.. Thats what she needs to write on the form. But, K1 visa... Both should be free to marry.. How is that possible if shes not yet annulled???? I am afraid you might have some problems later on, coz you need cenomar to prove singleness.

Im sorry but I think you can't marry her yet until her previous marriage is annulled.

08/01/2014: Received NVC Instructions & AOS Invoice (Email)

08/01/2014: Called NVC to rectify spelling of address

08/03/2014: Paid AOS fee on CEAC (in process)

08/05/2014: AOS Fee in PAID status

08/13/2014: AOS Packet Mailed

08/14/2014: AOS Received at NVC

08/15/2014: AOS Scanned

09/03/2014: DS-261 Reviewed according to NVC rep

Waited for 41 days (29 business days) for IV invoice :dancing:

09/09/2014: Received IV invoice (Email)

09/10/2014: Paid IV fee on CEAC (in process)

09/11/2014: IV fee in PAID status

09/11/2014: IV Packet Mailed

09/12/2014: DS-260 Completed

09/12/2014: IV Packed received at NVC
09/15/2014: IV Scanned
Waited for 35 calendar days for AOS Acceptance and Case Complete :clock:

10/21/2014: Case Complete :dancing::whistle:

10/31/2014: Received Interview Instructions (P4)

EMBASSY

11/04/2014: Medical Exam at SLEC (2-day process) PASSED!

12/01/2014: Interview APPROVED! :dance:

12/09/2014: Visa on Hand

Your Fiancee and her "EX" got a divorce in another country and both are Filipino? She is not processing her visa in the Philippines? Then she is fine.

Status needs to be single.
