My wife has a friend that is here on a B-1 visa working as a Nanny. I was under the impression that you couldn't work with a B-1, but it appears I'm wrong about that. The B-1 expires middle of September. She's had it since 2011 and she gets it renewed every six months. She has a card with her picture on it, which I'm assuming is some kind of EAD. She's planning on getting married and wants to adjust status. I assume there's no waivers or 2 year home residency involved since she's not on a J-1. Someone tell me if I'm wrong about that.

So I assume she needs the following:

I-130 filed by her husband

2X G325a. One for each of them

I-864 filed by husband

I-485 filed by her

I-131 (I know it's optional, but it's free)

I-765 (optional but free as well)

Can she send all these in together with one check? It looks like it would be:

$420 I-130

$985 I-485 + $85 bio fee $1070 together

$1490 in total

Am I missing anything? Thanks in advance for the help.

You are missing I-693, which is the medical exam.

You need 2 G-325A's for the foreigner.

Plus all the evidence.

No waivers; I am not familiar with the nanny thing and there may be something I don't know about. I believe it is only for diplomats staff or something. Where is her sponsoring family?

You need 2 G-325A's for the foreigner.

Forgot about the medical with the vaccinations.

I thought it was 1 G-325a for the USC and 1 for the beneficiary filed with the I-130? Do you need another G-235a for the I-485?

Her sponsoring family is here in Texas.

Yeah, you need another G-325A the I-485 for the immigrant.

I just checked and I guess the B1 is available for nannies and other domestic staff of non-immigrants. There is no bar to adjustment for her that I can see, but it is a rare circumstance.

Some lawyer wants to charge her $10k. I had to laugh at that.

10K for that??? Momma knew what she was talking about when she said I should have been a lawyer. Should have listened to my momma.
