Here's our timeline:

  • We met in the US in 2012 while I was on F-1
  • We got engaged late 2012
  • I was offered a job in the US requiring J-1 visa in early 2013, so I went back to my home country for a couple of weeks to get it.
  • I returned to US in 2013 on the J-1. No two-year home residency requirement. I have remained in the US since collecting the visa and started my job as normal, which I am still in. The J-1 is valid until 2015.
  • We got married in 2014

My question is: when I file for the AOS, does the fact that we were already engaged when I got the J-1 count as intent to immigrate? Could they accuse me of immigration fraud? I don't think I have done anything wrong - in fact I've always been meticulous about maintaining correct status in all the years I've been in the US - but I am anxious about it.

We got engaged but made no plans to marry immediately because we were going to wait to see how my job turned out. Indeed, that's exactly what happened: it was only after almost a year of engagement that we got married and we were certain we'd be staying in the US. So I don't see that as intent to immigrate.
