Not filing tax returns is a problem, yes. File the tax return. The first $97,000 and change of foreign income is exempt from tax but you are not exempt from filing a return. You file an extra form to claim the foreign income exclusion.

My partner (USC) has worked in Canada for the last 10 years. He has filed for the US income tax every year. He will be keeping his current employment and working from home in Seattle once we move there. His employer wrote a letter for us stating it's okay with them.

Since he has paid his income tax in Canada and the US has a tax treaty with Canada, he hasn't paid his income tax in the US. His salary shows up at "Wages, Salaries, Tips, Etc" under "Income", but his total income shows as "$0.00". I will be putting "$0.00" for the question 13 of "Part 6. Sponsor's Income and Employment" on the I-864 form and am stating his current salary ($#5,000.00 CAD) for the question 5: "My current individual annual income is:" in Canadian dollar since the employment letter states the salary amount in Canadian dollar. I will explain the situation that he is keeping his job on the cover letter and include a printout of the current US-CAN conversion rate.

For some reason, his 2012 tax document states his total income in a negative amount ($ - #0,451.00) rather than $0.00 (it shows $0.00 for 2013 and 2011). He made more money in 2012 than in 2013 or 2011, but it's less than $97,000 so it's not he went over the tax treaty limit, but I'm stating the negative amount as is since I don't want to receive a checklist.
