I meant filled out forms, and what if the lawyer sends in the forms and he does not show up for interview then what?

If the I-864 was submitted to USCIS and was not cancelled by him, you do potentially have the ability to adjust status without him and after a divorce.

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

1. lawyer sends in forms to USCIS - once the receipts are issued - a new period of authorized stay starts.

2. husband not show up at the interview? no green card issued. However - 1/3 to 2/3 of all Adjustments filed, where the beneficiary came into the USA with a K-1 visa - do NOT get interviews.

so - this 'what if' you've described - if any of it occured - please write more about it.

OP status listed as EB-3 Visa, so she would get interview.

I honestly don't know what your legal options are. It seems like many other have a better idea, but I thought I would write anyway because I too am in a relationship that hasn't gone well at all. It gets lonely and you sit and wonder if anyone at all cares what happens to you. If nothing else, let this be a note to let you know you're not alone. I am on the other end of it, being the US citizen, but it is crappy either way when someone makes you feel horrible after you believed so much in that person. I hope things get better for you. If you think about it, your record for living through bad days is 100% so although its awful now, you only have better days ahead. Try to stay positive although it's rough.

He basically filed all forms for green card, only thing left to do was send in forms and I told the lawyer not to because he wasn't taking my calls. And no he did not physically abuse me but he has caused me anxiety and has women texting me and harassing me, I think its very stressful and its,stressing me out a great deal. He sends me messages randomly and comes then disappears, that's cruel beyond belief.

If he has filled out and signed all the forms, and your lawyer still has them, then tell your lawyer to just send the papers to the USCIS. I guess you are married, right? You will get a 2-year GC. But you will have a hard time removing the condition. It will give you enough time to work on your marriage. Stay strong.

If your husband filled affidavit of suport for you and then did not go with you to interview you gona get dennied but you still have two good options. But u need a lawyer for that..1 vawa 2 matter of sesay

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
