Hello everyone. I have a little problem and would greatly appreciate some advice and guidance...

My wife and I got married nearly one year ago and is on solid ground. She is from Ukraine...Kiev. We are in the midst of AOS still, but she her Advance Parole for travel. From everything that I've researched, her four year old child is covered by the AP card/Ukrainian Passport etc.

Here's where the problem lies:. The biological father is now saying that he will not give the written permission for the daughter to return to the United States once they are there, which from what I have been told, is necessary (and he did so for my wife's original trip here). He's a bit of a "blow-hard" since his intention is not to keep the daughter in his care...he barely has any relationship with her since birth and he has the son of my now-wife, a son from his new wife and a daughter from of his new wife from another marriage.

What can I expect and how can I rectify this legally so there is no more problem with this now or in the future? Both my wife and step daughter are enrolled in school and I do not want in delays in their return.

Letting the daughter return to Ukraine would be risky.

I seriously doubt if you could do anything from the US side. I have no idea how the Ukraine legal system works, your wife might.

If the child is in the Ukraine and it gets messy then who knows what will happen, no such issue here.

Harpa...just wish I knew how to resolve the issue. Otherwise, my wife can't go back to Ukraine. Personally, with all that's going on over there right now, that may not be a bad thing. However, family should be able to see each other.

When exiting the Ukraine is it standard to be asked for written proof of permission to travel with your children from the absent parent at the airport? Is it a requirement to be able to travel solo with your children?

I ask because you don't need any sort of 'permission' to travel solo with your own children out of the UK and throughout the EU or the US.

The only time any questions might be ask is if your name is different to that of your children. I've never heard of anyone being refused or detained because of this however.

Russia and slightly different situation.

Mother had all the paperwork, made no difference.
