I 129f Taking a long time

Thanks for your response my number starts SRC does that mean anything are you sure they are not taking applications or maybe just mine

As others have already said, SRC is the Texas Service Center. Why did you believe it was transferred to Vermont? Why did you believe it was at the National Benefits Center to begin with? The NBC is not where I-129F petitions are mailed or processed. They are mailed to the Dallas Lockbox intake facility. From there, they are routed to either the CSC or the TSC. A transfer happens from one service center to another. If a case is actually transferred, a notice is sent that lets you know your case was transferred to whichever center it was sent to. If you never get a transfer notice, then it has not been transferred. The receipt notice from filing the I-129F will have the receipt number on it and the service center and address listed at the bottom.

Have the USC petitioner call to check on the case status and at least put in a service request for being past the average processing time of 5 months.

Because it says transfered to your local service center which is vermont, so maybe if they are not accepting anymore it is texas as no one tells you anything when you call you never no. I have put an e mail service request for it being past processing and I have called. I have written to the Governor of Delaware today to see if they can help. I hope that someone can help us 30 years is a long time.

it says in review same as for 8 months I just spoke to my partner he says it was originally in Texas and was transfered to Vermont so now I am confused I will call and ask where it is.

As mentioned by the rest, it does sound iffy if your files are indeed at Vermont since they stopped processing I-129fs since July 2013. Even mine which was originally assigned to VSC was transferred to TSC as early as May 2013.

Hope you get it sorted soon. Keep us posted.

It is indeed confusing. Some people mistakenly believe they are mailing their petitions to the TSC because the Dallas Lockbox is also in TX. They are not one in the same. I have not heard of any case being transferred from the TSC to the VSC. That makes no sense, since the VSC transferred all theirs to the TSC, and then from then on, none went to the VSC anymore, just to the TSC. When yours is sent to the TSC, your receipt number starts with SRC.

California = WAC

Vermont = EAC

Texas = SRC

They do not transfer I-129F petitions to your local USCIS office. Was the USC petitioner sent a transfer letter in the mail, or was this update about your local USCIS office from the online updates only? Perhaps there was a mistake with the update online, if that is the case. Did he receive a letter in the mail that stated his I-129F petition was transferred and now being processed at the Vermont Service Center?

Have the USC petitioner call and ask to speak to a tier 2 immigration officer. They need to speak to the USC petitioner, the one that filed the form, not the foreign fiance(e). Make sure he asks for the case to be escalated to a tier 2 immigration officer. Those that answer the phones for the USCIS are not immigration officers and cannot see any information about your case that you cannot already see online. They have no access to your case info and they very often give out misinformation. Never ask questions of and deal with the people that answer the phones for the call center. The USC petitioner can ask the tier 2 IO about the case status of your petition. They can tell him exactly where the file is and see how long it has taken. They can put in a service request for being past the processing times.

Hi Thanks for your reply. I have just been on the phone to the service centre and for sure it is in Vermont and she assured me that they are still showing processing times of 5 months for I129f she was helpful but I will get my partner to call and talk to a tier 2 officer like you suggested. I also have to wait until the 13th of june before I can put another request in to ask why it is outside normal processing times. I have a feeling that it is because of my history in the states and that it will come back to bite me. I basically lived there on and off for years and got caught on an overstay in 2010 where I was sent back, no deportation but obviously no longer able to travel on a visitors visa, it was less that 180 days so I know it resulted in a 3 year ban which was done in feb 2013, I am not saying that what I done was right but if I had continued to go back and forth on a visitors visa they would have sent me back eventually for traveling too much you can't win for loosing in that situation. I am hoping they will see that we are a real couple that was just caught up in a situation that we could do nothing about legally or am I being too optimistic.

I hope your fiance can get some answers from the tier 2 IO. I have not seen a case get sent the VSC from the TSC, so it does interest me to know why it was. Good luck and thank you for keeping us updated.

I tried every legal option I had it is very difficult unless you are a Doctor to stay in the states unfortunately we did not have the same rights as yourself and the options you have imagine meeting the person you want to spend your whole life with and being told no based on bias. I have spent nearly 30 years with him. I will never give up

I know everything will work out for you. My partner and I were talking about your case last night. Its horrific that the rules the government made about same sex ccoupls caused the over stay (I would have done the same thing 1million times over given the situation) but now that they change the law its an issue left you with this issue. Obviously I understand why, etc. But seriously. We have all had to endure so much due to not having the same rights as our hetro friends. My partner left her family, country, life for me and we are lucky that our situation has allowed us to be together when so many couldn't. If you need the name of a good attorney let me know. My guy specializes in same sex immigration. In fact I believe he was on the board for DOMA.

Thank you for your offer of help with the attorney, I am going to give it a couple more months and if nothing has happened I will keep your contact info and look at the legal options. I wish I could turn the clock back and do things differently but I have to move forward when I met my partner I knew from the first time I saw him that I would spend the rest of my life with him, so its hard to think of another ending to this.

Are you a gay couple? and how did you get your partner legal? I appreciate the e mail as sometimes I feel lost and beaten but I have a fight in me that will not give up.

We are a lesbian couple. We met when my partner was studying in Australia and applied for defacto residency. We are very blessed that the situation was what it was and she has an extended visa due to studying. That was almost 5 years ago.

I have no idea what the feelings you must have been going through for the last 25+ years are like.

Going through the AUS Perm residency was hard enough for us. The not knowing if you will even pass plus the extra layer of pressure because, who knows, the person approving your case might not approve of our relationship. It was a nerve racking time. I guess we are lucky that we live in a era which allows our partner choices to be more accepted.

The government somewhat understand now, etc. My heart breaks for you and what you have been through. I know what its like to fall in love with someone you can not live with out and have the threat of that being taken away, but on such massively smaller scale than what you have gone through.

Thank goodness for DOMA, I honestly did not think we would see it in our life time so we prepared to live in Australia for the rest of our lives. It hurt her so much being away from her family, friends and everything she knows.

Good luck with everything. I am sorry on behalf of all of the people who have kept you away from your love. Genuine love (in all forms) needs to be celebrated not punished. You did what you needed to do to be with the man you love and I respect that. Don't regret what you did. Your life could be dramatically different if you didn't over stay to be with your husband.

Keep fighting. We are so close to having everything we want and need. Obama loves us! lol
