We submitted our AOS paperwork (forms I-765 and I-485) which were received on May 15th and May 16th respectively. My wife received an NOA for both forms and has her biometrics appointment scheduled for June 13th. Our I-485 case was transferred to the Nebraska Service Center.

I wanted to check and see what a time frame might be for the processing of the I-485 and wanted to check on the USCIS website. Unfortunately, after selecting the right form, it then gives me 6 options, of which none is applicable to our case (as far as I can tell). They are:

- Based on grant of asylum more than 1 year ago

- Based on refugee admission more than 1 year ago

- Employment-based adjustment applications

- Under the Haitian Refugee Immigrant Fairness Act (HRIFA)

- Under the Indochinese Adjustment Act

- Under the Nicaraguan and Central American Relief Act (NACARA)

Anyone know where I can find out about processing times for the I-485 for K1 adjustments, rather than the ones listed above?

Thanks for any advice in advance!

No, you did not miss anything. Processing time of AOS from K1 depends on many factors. It usually varies from 2 months to 18 months. Below are the main factors that determine total processing times.

1) Weather you get RFE or not.

2) If you get RFE, how long you take to provide requested evidence.

3)Processing times of your local USCIS office if you are not a interview waiver case. If your local USCIS office is one of the faster one that doesn't have much backlog then your wife might get GC within 2-3 months and if your local USCIS office is one of the busy one like Atlanta then it might take 8 months to get GC. Now as your wife is adjusting from K-1 there is 50% chances that she might get interview waiver, in that case it will take roughly 6 months to 1 year to get a GC.

You can check processing times of local USCIS office for I-485 on USCIS website.

Good luck.

Thank you for your response. I am sorry if my questions was not clear. I understand that many factors contribute to the decision time. What I want to find out (from the USCIS website) is how long their estimate is. As I said, the only options available are the ones in my original post and don't reflect our situation. So, could someone point me in the right direction on their site, or confirm that this information is not available?

Thanks again.

They go by your local office's processing times, even if the case stays at the NBC. The NBC does not have any official processing times/estimates for K1 I-485's.

PS: Are you sure your case got transferred to the Nebraska Service Center? Normally all AOS cases get transferred to the NBC (National Benefits Center = Missouri Service Center).

Hi there. Thanks for explaining. I will just wait and see what happens then.

Yes, absolutely sure about Nebraska Service Center. Here is the copied text from the USCIS website when I put in our receipt number:

Acceptance

On May 16, 2014, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case. Please follow any instructions on this notice. Your case is being processed at our NEBRASKA SERVICE CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283

Since you sound surprised, should I be worried? LOL

I know about the NBC transferring I-130 petitions to Nebraska, but not I-485 applications for adjustment filers. http://www.uscis.gov/news/alerts/workload-transfer-national-benefits-center-service-centers

You should call and ask to speak to a tier 2 IO about your case status. Ask them if it really was sent to Nebraska and if so, why.

Thanks for the info. We called and confirmed it was sent to Nebraska and that all is in order. That is where it has been sent for processing. Will post an update once we have it.

Hello! I just received my Acceptance Letter this morning for Form I-485 and it was transferred to Nebraska Service Center as well. I am from New Jersey. :)

Thanks for posting this. It is a relief to see that and perhaps it shows that applications are being distributed to other centers to quicken the approval times or "to balance overall operational workload"...one can always hope :-)

Just wanted to share that my case was also sent to Nebraska Service Center instead of my application staying at NBC. I wonder why that is though? Could it be just a random thing or what?
