My wife who is the US citizen, hasn't made any of the legal changes to her new surname, should this be done before the application process or are we safe to apply before? If we are ok to apply before should she use her new surname on the forms or her maiden name? Sorry for so many questions lately, don't wanna get anything wrong. :help:

I just went to USCIS on Friday and they told me to fill out all the papers with my wife's new name. In our case she's the beneficiary, but the way the gentleman explained it to us, since we're married now, all documents are going to be done in her new name. He added "don't worry about the old name, just make sure all of your documents are using her new name."

(With all the ID numbers, I really don't even think they look at the names anyway!)

So are you saying its safe to go ahead, without changing her name legally? Just put her new name...even though its not on her social security no. etc etc?

I used my maiden name on the forms since we filed right after marriage and no time to change my documents. In the section for other names used, I put my married name. I don't think it really matters one way or the other, just stick with the same name through out the process.

Hmmm, thats interesting, now i'm REALLY confused! haha, seems like theres no SET rule for what name you put. Were just scared that if we use her new surname if won't link up to any official documents and cause us problems, we don't want any hiccups at all. Having said that there is a box for other used names... maybe its not too much of a concern for them, you'd think it would be though, its a pretty important peice of information, someones surname, right?

Well in her case she has an SSN so as long as she puts the correct ssn on the forms they are going to know who she is. We chose to use my married name to be on the safe side and to avoid hold ups. My w-2's and such did have my married name on them by the time we got to that stage, and we had no problems what so ever. Don't sweat the small things do what you feel most comfortable with, if she intends to change her documents to her married name soon then use it.

Sure she can, and then put the maiden name in as other names used. It's all as broad as it is long, just get your name right lol.
