Hi All,

I am about to leave for work in Brazil for the first time on my EAD/AP combo card.

The airline information asks for country of residence. Do i put the USA here?

Also, I need clarity regarding re admission in a months time. This is in regards to the AP being denied entry because of unlawful presence.

Well my I94 has passed but I was waiting for my EAD/AP card. My AOS is till pending.

Im assuming here that the unlawful presence would be if I had filed for EAD/AP after the 90 days of K-1 visa...

I originally entered on k-1...we got married and filed I-485 AOS along with EAD and AP soon after marriage. I have been waiting for my combo card which I received last week.

I just dont want any complications returning to my wife in a months time!

All advice appreciated

You are overthinking this.

Yes, your country of residence is now the US. You have followed the conditions of the K1 visa, got married and applied for AOS and not had any unlawful presence.

Just remember to take your EAD/AP combo card and be prepared to go through secondary processing when you re-enter. (i.e. it'll take a little longer just as it did at POE when you first entered with the K1)

AP is not a trap designed to somehow exclude you. You won't have any issues.

Agreed with Kiwinyc, stop over-analyzing. You will be fine. AP has been used by K-1s successfully though the years. Of course, aside from your EAD/AP combo card, just don't forget to bring your passport, or check as well if you would need a visa to enter Brazil.

Safe travels!
