You should keep calling. There have been some horror stories about cases not received

Called the NVC hotline and the very helpful lady told me that August interviews are out as they just "got" my AOS on 6/30 (even though it arrived a week prior), and it takes 30 working days to get it

Nvc received my case last May 30th. Called them last night for an update and the agent was really rude. She told me to wait for 30 days in a condescending tone . I hope someday these people will real

Hi Ingrid, I too was alone through out my pregnancy. Baby is two months old now. The process is taking a lot longer than I expected.

12/22/2014 - AOS checklist package and IV documents scan date

03/02/2015 - Case Complete!!! (70 days)

04/02/2015 - Interview in Dakar (221g - Needed to verify a court document)

Lots of people have and have had no problems. It is only a problem at the interview if they suspect fraud. It not an issue with nvc nor if the petitioner's income is well above the 125% poverty line.

No, because I was married. Married is married, whether or not they're in the country. You have to file married filing separately . You need to file an emendation immediately as this can cause problems at the interview.

Hey guys anyone here file taxes is single because spouse is in another country?

I am quite certain there are MANY people who accidentally file as Single when they have a NRA spouse. The online tax services and other popular products do not handle the situation at all. In fact, many CPAs and accountants regularly get this incorrect. There are likely numerous Visa Petitioners that have this issue. I have yet to hear of a single case where filing Single was the cause of a visa denial. That said, if your case lacks other evidence of a bona fide relationship it would be best to have the return amended for the correct Filing Status. The Case Officer is going to review your case as a whole. If you have lot's of evidence and no red flags then filing Single is likely not an issue and at worst likely you get questioned. Think about the thousands of petitioners that do not come here or visit other sites or blogs and have no idea how to file. The 1040 instructions are weak in this area. I know, I've been a CPA for 27 years.

The SAFE answer is to amend your tax return and adjust your Status to Married Filing Separate if your spouse lacks a SSN or ITIN. However many folks do wait until after their spouse has their visa and SSN and amend at that point. I've done a few of these 1040X amendments myself in my practice. So folks are certainly getting visas with the Single status originally filed. However you need to weigh your own risk in your case if you want to avoid a question by the CO that *might* ask a question. If you are worried, file the amendment asap.

Guys I just got the case number & IIN via email! Filled out the DS-261 immediately but can't pay the AOS fee for a few days it seems, I get the dreaded "Your case is being terminated" message, so I'll try to check it again on Friday.

God will this mean we can actually do our interview in a month or so????

You file it as married. My wife doesn't have SS so I've checked with the IRS and they said once I file (I've gone for extension) I can use the file to get my wife a Tax ID. But I think by the time my accountant is done telling me how much I owe Uncle Sam (usually in September) I think she would have an SS already.

I tried looking on the email attachments but didn't see anything that indicated when they were received, but my NOA2 was sent on May 14 per USCIS, so this is pretty much in line with most people so far.
