Interesting facts in Sudan:

Muslim women cannot marry non-Muslims.

Muslim men can marry anybody

Children must always follow the fathers religion

Leaving the Muslim religion is punishable by death

Nice place.. I am curious what the Quran says about leaving the religion....

Also the lawyer from the family said the reports of her being set free are false.. She was given two years so that she can breast fee the baby then will be given the 100 lashes, then be put to death.. Her other son is with her in prison..

So women in Sudan can't apply for a K-1 or CR1?

They filed for for a spousal visa with USCIS way back in December 2011. One of the things the State Dept. has demanded of the husband is a DNA test to discern whether the kids are his or not(!) before they'll help.

Shameful that Obama put 500,000 illegal aliens in front of us at USCIS, but can't seem to use his "pen & phone" to save help this fellow apostate from the barbarians.

I assume you're trying to be funny. The woman is chained to a wall and will ultimately be murdered by these monsters.

The US should weigh in on humanitarian grounds if they can't find it in themselves to grant her the same "rights" as an illegal alien.

The marriage was declared null in Sudan.. She is getting 100 lashes for adultery - she slept with her husband but since the marriage was considered to be illegal in the first place she was seeping with someone who was not her husband - so she gets the 100 lashes.

So the point I don't get is, does this mean it is impossible to apply for a CR1 or K1 in the Sudan if one is a woman?

I am curious as well - I'm not an expert on the subject, hopefully someone in the know can pipe in but here is my guess:

The K1 would be fine in any case since it is the US side that is approving the intent to get married and there is no law broken on the Sudan side.. I could see there being some issue if she was muslim and he was not but only if she is required to alert authorities of her plans.

The I-130 would be fine assuming the US Male is Muslim or the woman is non-muslim (since would have no restrictions on who she marries) as the marriage would be legal in the Sudan..

That does bring up the matter in this case of the current I-130 - the marriage has been declared nullified so they are not legally married in Sudan so how does that play out in the embassy? Are they considered married?

If the marriage was performed in Sudan and declared null in that country there is no grounds for I-130.

As a purely selfish American: The guy comes here with his brother, bootstraps himself and has a degree in an advanced STEM field. He finds a wife in the old country who is a fully educated Doctor, brings her here (hopefully) and we will get the benefit of a lifetime of work from her without having to spend a cent on her education. Score one for the home team.
