Couple K1 Questions

Timeline

Thanks for bearing with me folks ... yes I have tried to search but coming up somewhat short.

1) My passport expires Nov 2010 ... the I-129F asks for 5 years of validity. Should I renew?

2) The current downloadable I-129F expired 12/31/06 (rev 05/23/06). The USCIS website indicates this is fine. Is a call to the USCIS or local service center to make sure in order?

3) My parents became naturalized citizens while I was about 5 years old. As far as I understad, I got naturalized by default - but was never issued a naturalization number. For #10 on the I-129F, I checked "Naturalization" **and** "Parents" and put my dad's certificate of naturalization number, date and place issued in the box. Is this kosher?

4) For proof of having met in person in past two years, I've included (i) 5 color, dated photos location labeled on the back spanning Feb 05 to Jan 07; (ii) travel agency issued airline itinerary with dates and both of our names on it; and (iii) airline boading passes with dates and our names on them.

5) For proof of ongoing relationship, I've included (i) my most recent cell phone bill showing text messages to the same number (amounting to over $100!! That monthly rate alone makes economic sense for moving in haha) and (ii) email correspondence. We're trying to find proof of her cell phone number on her end but it's tough since they use prepaid cell phone cards.

6) How'd you folks ship your application? I'm thinking plastic protectors slipped into some sort of presentation binder. Overkill?

Are you the beneficiary or the petitioner?

As far as I'm aware, a passport only needs six months left on it for a visa to be issued. If you are the petitioner, they won't be putting the stamp in your passport anyway.

If USCIS website says a form is fine...it's fine.

Put your parents names in the boxes like the instructions say. If you want to list their natz certificate numbers, do this by an attachment.

Your proof of meeting sounds adequate.

Try putting the petition together fastened at the top with ACCO brand fasteners. That's the way they will bind your file through the process, so your packet is already neat and tidy and ready to go in with their papers.

Note that the item you've quoted only says the passport has to have been issued with a validity of at least five years, that is, its expiration date must be at least five years after its issue date. It doesn't say the passport validity must extend five years beyond the current date. Note that the I-129F instructions say that the passport must be unexpired, and must have been issued with a validity of five years. There wouldn't be much point in insisting that it be unexpired if the phrase "issued with validity of at least five years" meant that the passport expiration date must be at least five years into the future.

Most passports issued to adult US citizens have a validity of ten years. Passports issued to minor US citizens typically have a validity of five years.

Asked so many times I just cut and paste the answer from other posts.

That is the date that USCIS has to make suggest any changes to the form to the Office of Management and Budget (OMB), not when the form will no longer be accepted, it is not the expiration date of the form just the date that suggestion period expires.

USCIS will continue using that form until they decide to make changes.

See the date at the top of form I-864 for example, it expired 11/01/06, they are still using it

3)

Were you born in the USA? If so you are a citizen by birth. On 10 you would put birth in US and nothing in the certificate box and provide a copy of birth certificate.

If by parents they have to have got you a certificate at some time by filing form N-600 for you. How did you acquire your US passport? prof of citizenship like your naturalization or birth certificate is needed to get a passport.

4) and 5) You got it correct.

I just have another quick thing to add. If possible submit pages of your passport with entry/exit stamps on them with your visits to see your fiance.

Again, thanks for bearing with me and any feedback much appreciated.

My answers are just based on what I've read before, and what makes sense to me, but take with a grain of salt everything that you read on VJ or anywhere else. But heres my 2 cents (mostly repeat):

1)Should be good assuming it's an adult passport and has a validity date for 5 or 10 years (meaning, if it expires in 2010, then you've had it since 2005 or 2000)

2) Yes, use that form

3) Since you have a US passport you can just copy every page of that, and that should prove your citizenship. I don't know much about naturalization but if you were born in the US i think that makes you a citizen automatically? Do you have a birth certificate?

4) sounds good :)

5) Some people have told me that they aren't interested in proof of an ongoing relationship at this stage and that it should be saved for the interview. Don't forget to include signed statements from both you and your partner that you intend to get married though. You can also include proof of your intentions to get married, ex. engagment ring receipt

6) personally, I paper clipped each individual section (ex, one paperclip for the coverletter, check, I-129F form and supplements, one for all of my G325A copies and passport picture, one for my boyfriend's, one for citizenship proof, one for our statements and one for the documents we submitted as evidence) and then I put all of them together with a big acco clip. I found this was a good way to organize, and I think the CSC will appreciate it, since its so easy to take apart. On their website they also say to punch holes in the corners. I didn't see this in time though.

Thanks you guys ... I swear I've read the guides over and over but still manage to overlook some parts I guess.

Not to beat a dead horse, but just to be sure, the acco fasteners you are talking about are these things right?

As to question #10 on the I-129F, I was NOT born in the U.S. but moved here with my parents when I was about 3 years old. They got naturalized and have their certificates. To my understanding, I got naturalized by default but I don't have a certificate as far as I know. After reading the advice above, I was planning on checking "Parents" and adding their certificate number, date of issuance, and place of issuance as an attachment. I was also planning on including a copy of my passport as additional proof of citizenship. Does this sound about right?
