Congrats to all CC's .

I am waiting for a case # so i am starting to gather my papers. ( I have printed Saylins WIKI and i read it every night before i sleep. My temporary bible :wow: )

I am going to do the 864 EZ . I have filed taxes for 2012 and 2013 (1040) I received the tax transcript for 2013 .

2011 unemployed therefore i will put 0 . correct ?

2012 & 2013 i will put whatever # is on line 22 on the 1040 correct ?

Last question .

Since i was unemployed 2011 and do not meet the poverty line (of 4 members) on 2012 but over exceed the poverty line on 2013 and my paystubs this year almost reached the amount required so far . Do i have to have a joint sponsor ?

The poverty line for your household size is compared to your current income which is calculated by your actual pay checks over a one year period reflecting what you currently make. The numbers from your tax returns are not what they use to compare to the poverty line, so what you have on there from 2012 doesn’t matter as long as you report it exactly as it shows on the tax return.

Also, I have no experience with the EZ, but I have heard that the value is not line 22, but actually line 37. I will wait for someone to confirm or deny this though. Did you file in 2011 even though you didn’t work? I think in your case, only submitting the 2013 transcript return is best if you did not file in 2011 since then you will have to write a letter telling them why you didn’t file in 2011. If you didn’t file and just write “0” then I think you should be OK without submitting a transcript for 2012 and 2011.

When filling out the I-864, if you have a joint sponsor, you can only report the beneficiary’s income and assets on either the main sponsor’s I-864 or the joint sponsor’s I-864, right? So, for the I-864 which we DO NOT include that money on, do we write “$0” for those values or “N/A” for those values?

For me, I just left the assets section blank because I did not use any assets as part of income, I did not have any problem for this section of the AOS.

I was told in another thread that you do need to get a current professional appraisal done. I was also told that they will not accept property that is currently being lived in by the sponsor as the primary residence. My joint sponsor does own an apartment building that is separate from his home. However, as it stands now, my joint sponsor combined with his household member have a current household income that exceeds the poverty line for their household size. In addition, they already have over $300,000 in liquid assets that they are reporting, so it seems to me that it is unnecessary to include the real-estate on the I-864. I worry that if we include it without the proper documents, we will get a checklist (for something we shouldn’t technically even need according to the criteria.) What do you think?

I heard the same thing you can't be living on the property you use as assets. I don't think you have anything to worry about. If they are at or above the poverty line for the total people under their roof including the sponsored persons then your fine but you can use bank accounts, CD's things like that I think all you need are bank statements. My parents get them from their bank every 3 months and that is what we were told to use.

But to answer you, your all good, but I would show bank statements to be extra sure they can't reject it.

Hi Tino.. If I remember correctly, you mentioned in a previous post of yours that you are filing for your wife and child? If that is the case then unfortunately you cannot use the I-864EZ.

One of the conditions to be able to file the I-864EZ is that you are only sponsoring one person.

As for the 1040 line 22 is correct you need the Total Income figure.

Since in 2013 you are making more than the poverty line for 4 people and your 2013 IRS transcript reflects that then you don't need a sponsor. You also do not need to include transcripts for 2012 and 2011, it is your choice. So you either send just 2013 IRS transcript or 2013, 2012 and 2011. The choice is yours.

However on the I-864 form, Part 6, Section 13 it does ask you to confirm (by checking the box) that you have filed Federal tax returns for each of the three most recent years. (This is regardless if you will be sending the tax information for the 3 most recent years or not)

Since you hadn't filed in 2011, you will have include a letter of explanation as to why you were exempted from filing that year.

My DS-261 page status changed yesterday and now is displaying the following:

"Please contact the National Visa Center , if you want to change the Agent/Attorney Name or Address Information on your case.

To process your case, you must first pay any required fees. Then, each applicant accompanying the principal applicant to the United States will need to complete the online IV Application (form DS-260). The IV Application may be partially completed and finished later, or may be completed at one time. However, once submitted, please contact the NVC if you need to update the form.

After submitting the DS-260, mail all supporting documentation (as listed on the Documents The Applicant Must Submit web page) for each applicant to the NVC.

Once received, it will take the NVC 2 to 4 weeks to review your case. If any additional information is required after the review, the NVC will notify the applicant (or the applicant’s agent)."

Is that normal or does it mean the DS-261 requirement was waved? For the record, I have an EB1 case where I'm the petitioner/principal applicant and no attorney is involved.

I totally understand how you feel! Sometimes I wonder how these people passed their bar exams when they cannot copy 5 numbers from one sheet of paper to another! Our paralegal screwed up by rounding up the total income instead of putting it exactly as it was. We got checklisted for that. So they redid it and when my husband went to check, she'd rounded it up again on the new forms!

Please don't tell me it was sent again this way! :bonk::bonk:

My incompetent lawyer wrote the wrong zip code on the AOS. It was received on 5/22 so now I'm expecting a checklist over a f*#king zip code. I hate this woman with a burning passion.

My lawyer put the wrong income after I begged and pleaded with him not to use that number. He kept saying " Jen, they aren't going to question it since you are over the poverty guidelines" I had an argument with him over the phone... Then I get an email from him saying the office assistant forgot to get him to sign the AOS because I was pressuring them to rush...... OMG I was fuming !! As if 11 months wasn't long enough to gather my info..... I sent the correction 2 days after he sent the incorrect one. I didn't wait for the checklist... ( and I did get checklisted)

I honestly don't think they will checklist you for a zip code. Just my opinion but I think they are more worried about the income numbers. Maybe the zip code can be corrected at the interview.

Shocker of the day !! I started dialing the NVC at 2 minutes til 7. OMG, when I dialed at exactly 7, the phone didn't even ring and Gina picked up the phone.. She was laughing when I said how surprised I was that it didn't ring. She said I was her first call. No interview scheduled BUT she said she would update my file removing the mail that was supposidly received on the 23rd. I explained it was BS...only an email that they sent with someone else's personal information.

She confirmed since our email addresses are on file, we all will get the CC notice and the Interview instructions. Good ol' Waldo told me I will NOT get the emails....

I hope everyone who calls today gets GINA...

Very funny Soloenta. If that was the case, my case would be COMPLETE :P. But it's not.

They still haven't gotten to May 12th of mail... Ann told us last night they still haven't been reviewed... :cry:

I think maybe Monday or Tuesday for you !! If they were working on the 8th on Monday.... I think its totally possible !! Then you maybe a July interview too !! YAHOOOEY

I'm following your time line now! My IV was scanned in on May 16th. I let go of July interview :-( But I won't say no if we make it!!!!

5/21/2016: Mailed I-751 packet to CSC

5/23/2016: NOA1

7/29/2016: Biometrics Appointment

11/22/2016: I-751 Approved!
