Mmm.. Yes, you might want to talk to him. He could be filling out the correct form I-864 but he might be confusing whose income he needs to declare (his as the sponsor, not yours) or, he might be trying to include your current foreign income as part of his total household income. For the latter, he can only use your current foreign income if it will continue from the same source after you immigrate (proof needed).

Hi can somebody please help me. I am having an argument with my husband since he said that there was a question in the i864 asking for my monthly income. As fas as I know there is no question in the i864 thats asking the beneficiary's income. He filed for HOH on his tax. He has his 2011, 2012, 2013 1040a, employment letter and paystubs ready to be send tomorrow. But I asked him not to send it yet since I think he is making a mistake filling up the forms. What can we do? Can we file i864ez because its a simplier form right? He has a daughter living with her and I am the only beneficiary that he is sponsoring. TIA!

It has been exactly 2 weeks now since I got my case number and I still can't pay the AoS fee nor can I fill out DS-261. I know I need to be patient but is it taking this long for anyone else lately?

BTW, I called NVC last Friday and talked to Joy....... when I gave her my case number, she asked for my email address but I already gave them my email address when I called to get my case number. Do you think they didn't enter it into the system and it resulted in a delay for my AoS fee and DS-261 or do you think she simply asked to confirm?

They do confirm contact info when you call, so I doubt that was holding up your case.

If you still haven't received your AOS invoice by email by tomorrow (after the business day today), I'd give them a call to see what's up. (I suppose they could be saying it takes 30 days now, but when I received my case number on June 4, they told me 10 business days.) Good luck! The NVC has really slowed down, as I'm sure you've seen.

I am not sure if this will have an effect, but he should have filed an for ITIN for you when he did it.

It might cause problems at the interview if the consular officer has any reason to doubt the legitimacy of your marriage. Your husband can file an amendment to his tax return and change his status to "Married, Filing Separately". (As far as I know, you wouldn't have to file since you presumably have no US sourced income.) Under the spouse's SSN, he'd put "NRA" for non-resident alien.

Then you will have a tax return or transcript that shows him filing taxes as a married person. Saylin's wiki about the NVC process touches on this issue, so go back and read it through again.

Whats up is that they are backed up from USCIS and it's not going to change by calling but wont hurt either. Just a waste of time since we have all been waiting for it for a VERY LONG TIME! Used to be very fast but not now. As I said it's up to you but it's not going to change a thing.

No, calling won't improve the backlog or make things go faster. The backlog is what it is. I was suggesting that if the OP has waited more than two weeks since receiving his case number and hasn't gotten an AOS email yet, that's longer than the timeframe quoted to me on June 4th. I would call in that case to make sure nothing is wrong.

Hi can somebody please help me. I am having an argument with my husband since he said that there was a question in the i864 asking for my monthly income. There are no questions on the I-864 specifically about beneficiary's monthly income. If anything, all income is expressed as annual income on the I-864. Few things he should considered and review again:

- He is the sponsor, so he should be entering his annual income as the qualifying income to sponsor you.

- Will you continue to work in the US and receive your income from the same employer in the Philippines after you immigrate? If not, then he cannot use your income.

- Is his annual income alone 125% of the poverty line to support himself, his daughter and you? If yes, then he doesn't need to include income from anyone else.

He can file the I-864ez if he qualifies for the 3 rules: He is the only sponsor/petitioner, he is using only his earned income, and you're the only beneficiary under the visa petition.

Yes, this can be a huge problem. Read the last section in my wiki on my thoughts and advice about filing single.

I am not sure if this will have an effect, but he should have filed an for ITIN for you when he did it.

Not necessarily. You can file as MFS without needing an ITIN.

It does NOT matter where you are at in the process (waiting for case numbers, waiting on bills, sending packages, etc), everyone moves over to the new thread. This is not like the I-130 threads where you stay in the same thread the entire time. We're different ;) We all move to a new month each month.

And if you don't like it, that's too bad as Ryan will come along in a few days and lock this thread :P :P

I talked to them last week and it is taking 10 to 20 BUSINESS day's . You should be able to pay your ds-261 in a few days if not this evening. I logged in the day before they sent me the email.

Oh God! We didn't know about this. Then if he filed an amendment how long will it take to finish the process? Can he get a copy instantly? If not then how about the AOS needed in NVC, can we submit first the copy of his SINGLE tax return and I'll just bring the copy of the amended one in the interview?
