samreen23 - i have no clue , we have the same question on this. except mine is slightly different.

my wife is the US petitioner and lives since 2010 with me abroad. she hasnt worked at all since she lives in the Netherlands.

we got married in 2012.

the IRS says she is NOT required to file tax (1040) since she has no income.

so we now the IRS sended us Non-Filling Letters from the past 3 years.

the problem... or maybe not, is that on those Non-Filling letters her old married name is printed. since she hasnt filled any tax returns after she got divorced in 2008.

the IRS says that this is the only information that they have under her social security number.

maybe someone can get an answer in this

Yes exactly. i want to be sure before we leave such an important box unchecked. and also husband made sure he fills out the whole form on the phone with me because i brag so much about visajourney so i dont give him a headache later on that why he made a mistake :D so i wanna be damn sure what i m talking about to him lol!!

On the instructions it says make a continuation page... put a note saying to refer to it due to address too long....

I think your tax returns have to reflect the name your social security is under. It confuses them if you put your married name, and trying to match them up.

My wife wasn't required to file for the year 2012, because she was migrating and thus had no income and was a student. She just wrote a note in the cover letter and a continuation page that she was not required to file for a tax return due to not making no income that year. They accepted it. No problem. She didn't check the box, because it says if you filed for each of the three most recent tax years, which she didn't file one year.

thats the funny part.... when we got married in 2012 we went to the social security office and changed her name into her married name ( mine)

so her SS is good.

but the non filling letters from the IRS state her formerly married last name.

and the IRS claims that they get the name change and other information from the SSA

She never posts on here. She usually only used it to talk to Soloenta or Bdrew by PM :P.

I couldn't agree more! Slow down, read and re-read the instructions. I think people are making this harder than it needs to be.

The ONLY thing that contradicts the instructions is the whole 'blank vs N/A' thing, but that's been explained to death on here. Take an extra day to to review the AOS before sending it out. Lots of people are getting preventable check lists (unless you have a lawyer, in which case raise some holy hell!). Breeeeeathe :-D

Plus, sometimes you CAN'T control what the NVC will checklist for! They like to make their own rules up along the way ;).

Well said. This process is so frustrating and shouldn't need to be. We have a similar timeline, so fingers crossed we cross paths in Sydney at an interview very soon!

Rock bottom. I called and spoke to Arthur (who is a JERK by the way) who said we had received a checklist for our AOS package. He kept telling me that my sponsor hadn't included his 2013 income. I agreed that he hadn't, but that was because he had an extension approved on is filing and that the letter from the IRS confirming approval of his extension had been included. All information provided was for 2012. Long story short, I eventually spoke to supervisor Kylie who confirmed that a formal review would be done and to call back tomorrow. I asked whether my package could be reviewed without the need for a joint sponsor given I had satisfied the assets requirement, but she said that I would have to submit a withdrawal of sponsor request to do that.

So I think I'm stuck either way - submit another copy of the IRS letter or submit a withdrawal of sponsor letter. Either way it will add another 30 days. I just don't know whether I should get my aunt in the US to post one of these things today so it's there tomorrow, or if I should wait and speak to the supervisor tomorrow knowing that that will out another weekend between us and a case complete (in addition to the extra 30 days).

Any advice? I genuinely don't know whether the letter from the IRS was included - I sent all information to my aunt and uncle and asked them to add theirs to the package before sending it to NVC.

Separately - got the full Arthur experience when he started the conversation by tearing me to shreds for using Skype and my voice not being loud enough. He must be deaf because no other agent has had any trouble hearing me before. It went downhill from there...

I called again today, our AOS has been approved and i should bring the missing document on my interview, what exactly will be mentioned in the interview mail. NVC doesn't need anything else for AOS... Huh... DS 260 has been reviewed and accepted, BUT IV package has not been reviewed yet, to wait for the info in the next two weeks or longer... It's been 4 weeks till now... I hope they will review the package sooner... hope... hope...

I had it luck till now all the NVC representatives was super cool and nice :)

I'm so sorry you had to deal with Arthur. He does that to everyone. My poor wife got him twice. Once he hung up on her, and the second time he did the same fiasco. "If your'e on skype..!" I remember her getting very strict tone and said "I'm NOT using skype!". He must be deaf..!

Well, we hired a lawyer two weeks ago and we are still waiting for the IV invoice. So there's that! Ugh...

You need to have a lawyer attached to your case BEFORE the NVC stage, otherwise they obviously can't be automatically selected as agent when they input your case. Hence why you had to fill out a DS-261, since you had no legal representation already.
