My Wife is the sponsor ...

And she sponsors me only --spouse--

And all the income is from a sallary

Which i-864 shoud we use ? I-864 or i-864EZ

It depends, did she file a 1040 or 1040EZ? (EZ being the key part here)

im not sure about yours because I received an email stating now i'm enrolled in EP and i was assigned to a new case number.

Only the embassy in Guangzhou China is different because EP and mail-in are different case #. I had GUZ first then after enrolled to EP, it changed to GZO.

So Im not sure if they still send out the enrollment email confirmation to other countries who are qualified to EP. I'm still waiting for my IV fee. I resubmitted DS261 accidentally on may 30, my original was May 19 too.

You def should call in and ask what is going on, I did call them to ask if they are reviewing my AOS. They said they started reviewing on June 11th.

Good luck!

I have AMM and that means I must send documents electronically. I'm guessing that for this reason, the case number will not change, since everyone with case numbers begining in AKD, AMM, DMS, GZO, MEP, or SAA are already expected to send it through EP. But GUZ is optional, so I guess I would not receive an enrollment e-mail and instead they will just review them in due time.

Anyone can chime in?

WRONG, it doesn't matter what your citizenship is. Visa interviews are conducted where the applicant legally resides.

The section in bold and red is also incorrect. If a person is a citizen or born in country A but legally resides in country B, they can interview in country B.

You previously stated that your spouse is living in China right now on business and you previously indicated that on the forms; your spouse will be interviewing in Guangzhou

that make sense, thank you very much on your response,

What tax form was filed is irrelevant to what I-864 form to use.

I don't know if yours is Embassy specific but I asked the Embassy in Cairo a while back and they said it didn't matter if it was the country of birth or not since some people work abroad.

thank you for your information, that make sense

Finally got an e-mail response this morning from nvcinquiry@state.gov regarding my husband's change of address/moving the embassy process from Bogotá to Buenos Aires. I sent the two e-mails May 24, so it took 16 business days. This is what the response said:

The correspondence submitted is currently under review. An appropriate action will be taken once this review is completed.

So, 16 business days just to get someone to read it, and now they need to complete a review. I included seven attachments with the e-mail I sent showing he is living and working in Argentina legally. Passport bio page, passport entry stamp to Argentina, copy of his valid Argentine I.D. (two pages), copy of the document showing he is paying taxes as of April 2014, translation of that document and translation certification signed by me. That had better be enough. Hopefully the review won't take long.

In other news, I was finally able to FedEx the AOS/IV stuff to my parents' house in the U.S. yesterday. When my mom gets back from a trip this weekend, she will sign the I-864A and they can finally send our AOS package. I am a little worried about the domicile stuff, but I am trying not to think about it. I included everything I could. We'll just have to wait and see what happens.

April 17, 2014: Changed mailing address with USCIS Tier 2 representative. He also confirmed that our case had arrived to the CSC and that our NOA1 date is April 3.

April 18, 2014: NOA2 e-mail received at 12:30 a.m. Case status online changed to post-decision activity; date of "last updated" changed to April 17. Change of address e-mail received at 3 a.m. Status changed back to initial review on e-mail and online. Date of "last updated" now April 18. Called and spoke to two Tier 2 reps; both were useless.

April 21, 2014: Approval confirmed verbally by Tier 2 rep. Order put in to send second NOA2 hard copy to new address. Instructed to ignore online case status.

Another point where my lawyer was incorrect then, apologies for that

The only part where which tax form was filed is important is on the question about the three previous years' tax income.

I-864: Part 6, Question 13a-c

I-864EZ: Part 5, Question 19

If you read the instructions for those questions (depending which form you're filing), there should be nothing for me to explain.
