Just called nvc and found out that our AOS PACKAGE was scanned may 13th but send may10th our IV CIVIL DOCS was scanned may 22nd but send may 16th and wasnt even touched and reviewed yet ughhhh! I also asked if what date are hey currently working on right now and he said he doesnt have the exact date and spiel the 30days script...

oh no....but you should def call them and talk to a supervisor to explain that situation that you already knew you sent something wrong and would like to correct it to avoid any delay and see what they will say.

But I think send two different documents under same barcode will confuse them if they don't know the situation and it might be risky for more delay. But im not quite sure...

there is possibility that they won't issue any checklist, i think it really depends.... cause I heard many people got checklist for not putting N/A, and many people did not get any checklist for same issue....keep finger crossed....

Do you know any source for sure that with additional rental income, I-864 should be filled and not the EZ version? Since Dwipal submitted EZ version in similar case and didn't get a checklist so I hope mine goes through fine as well.

Called and got our case number today! I tried to fill out the DS-261 but it says that further processing on our case is not available at this time. I read in the wiki that it can take up to a week until you can do DS-261. How long has it been taking for people lately?

http://www.uscis.gov/sites/default/files/files/form/i-864ez.pdf This is the form you filed I believe, if you look at "b", it says I'm using only my own earned or retirement income, which is documented using IRS Form W-2. if you no (use I-864).

it says " the income you are using to qualify is based entirely on your salary or pension....." So I think Rental is neither of these. because Rental income is under Schedule E on tax return. Schedule E is more like investment income. I'm saying is because I work at CPA firm, so each income do matter.

What do you think? correct me if I'm wrong.

We were able to fill out the DS-261 online 8 days after receiving our case number. Just keep trying every day.

I can't remember the answer: when does the NVC notify of a Case Complete, if at all? Or do they only notify you when you have an interview? Jw. Thanks.

The I-864EZ instructions specify that the income you use to qualify must be shown on one more W-2s, and rental income obviously is not. That being said, if you do qualify based on salary alone, I would think you could file the EZ and submit your W-2s along with it to show the portion of your total income that is accounted for by your regular salary -- similar to how a sponsor using only his own income but with taxes MFJ has to submit W-2s to prove individual income. That's my best guess but if I were in OP's shoes I'd be calling NVC and defaulting to the I-864 if I couldn't get a conclusive answer. It's great to be able to use the short form, but the hassle of using the long form is much less than being set back by a month for a checklist.
