I figured your tax preparer would say something like that. Just like Sukie said, whatever their reason may be (clueless, lazy), tax preparers mostly use their online filing software and most of this programs require that you put a SSN or ITIN for your spouse. In this situations, it is recommended to file taxes manually and submit via snail mail and just type "NRA" (non-resident alien) for your husband's SSN. At this point, just do the amendment and send it via mail to the IRS. If you are not comfortable doing it yourself and you do not want to deal with this person anymore, take all your tax docs to another preparer and explain your situation and you need them to do. Again, do not let them tell you it cannot be done.

Not sure about being claimed in your parents' taxes and how it would affect everything. Unfortunately, I'm not too familiar with that aspect and I would hate to give you bad advice. Other members might chime in on that. However, you should be able to get everything done in the next few days and it should not delay your process.

I didn't file married , I filed HoH as I always do and mine was accepted No Problem. I just want to know what the big friggin deal is... all they really want to know is if you make enough money , right? I mean... is it really worth all this hassle of filing married when they aren't even living in the US and don't have a SS#??? I don't mean to sound like a wise-a$$.. I just have been wondering this for a long time.

For me personally, I'm not filing married until he is here and is working and has a SS#.

Checking in after a couple of weeks silence... turns out life outside VJ does still exist! Who knew? ;)

Have now paid the IV fee, posted the IV package and completed the DS260. The Fedex site suggests our IV package will be delivered to NVC around 10.30am Monday so then the waiting game will begin again. Somewhat concerned that we are going to be checklisted for the AOS package but when I called on Friday they said it wasn't even under review yet. Tuesday will be 2 weeks that they have had it so I will start harrassing them then :devil:

In other news, I called last week and I DEFINITELY selected option 1 for English speakers and my call was answered in Spanish.... again. I told him that I had selected the English option, which he acknowledged to be true, but then he proceeded to switch between English and Spanish throughout the conversation so it took about 10 minutes after I had to clarify everything he said when really he could have answered my questions in about 30 seconds. Grumble grumble... as long as they process it quickly, I don't care what language they want to speak! :)

How rude and unprofessional of this person, can't believe the people they hire. I had one that hardly speaks English and I could hardly understand her. Really this is about immigration it's a serious endeavor not asking if they still have toilet paper for sale. Wish we could work from home I would love to do their job. :pop: ......... :whistle:

Well my accountant told me that if I amend my return after the wify got here then i'll be in trouble with IRS because they will know that she didn't come here in 2013 so there is no point to amend it.

I filed as HoH too and not worried about this.. *crossing fingers*

I'll be honest, my 2012 taxes are single. My AOS was accepted. I don't expect trouble at the embassy. I have been living in CR with my husband for three years. There's nothing funny going on, it just so happens that the accountant filed "single". Plus from the reviews I've read, the San Jose embassy is pretty easy going. They ask two or three questions and that's about it.

I'm not going to amend my 2012 taxes. I honestly doubt they'll even notice. Our relationship is SOLID.

Filing HOH is fine. But filing single while married can be seen as a red flag by a CO (since you're filing for a spousal visa), especially in high fraud countries.

I'm not sure if anyone's actually been denied based on tax filing status, but if I were going through a high fraud/MENA country, I personally wouldn't risk it.

Edit: Plus, if one files single when they're married, they're lying to the IRS and if caught can get in trouble.

Ok so many of you have helped me with this tax 1040 filing single or married.

I have called my tax lady and i tried speaking nice with her and then she got an attitude. Ughh i lost it on her and I shouldnt have. Well she does my mothers taxes and she called my mom. She told my mom there is no way to file me married unless i have a federal tax number for my husband. Did anyone else have a federal tax number for their spouse? She said to get one my husband should go to the consulate with our marriage certificate and ask for one. Honeslty i dont believe or trust what she is saying. Help please can anyone confirm or deny any of this info.

She also said since my parents claimed me for the year that if i filed an admendment they would also need to file an admentment. I just want to cry, why didnt she tell us any of this when we filed!! She knew our situation

I was in a similar position except I was not claimed by my parents. When I was filing for my tax return my friend who is a cpa/professor said that I have to file single bec husband is outside the country and don't have tax number but when I read here everyone said I have to file married filing separately because I was married. I did a lot of research and spoke to other tax professionals and confirmed MFS is the way to go. You just put NRA (non resident alien) in the line where they ask for spouse SSN and mail it manually. U cannot efile in this situation.

In my opinion maybe before people were allowed to file single even if they are married in this kind of situations but tax rules change every year and maybe the person u went to were not aware of the changes, my cpa friend certainly were not aware I can put NRA and file MFS. He kept insisting I file single so i get more refund but I told him maybe IRS won't mind but what about immigration. He was not sure.lol

Anyway yes he can also get a tax I'd number or federal I'd number so u can file married filing jointly but it's a lot of work and will take a long time. I found this info on the irs.gov website

I called NVC at 7am (EST) and waited for 40 minutes to talk to Joy! Lucky me! :rofl:

Joy gave me my case number, but she refused to give me the IIN. :wow:

She was pretty bitchy on the phone, but I wasn't surprised a bit (since I heard about her on this thread) so I managed to keep my cool! :yes:

I'm calling them back again now to get the IIN. I hope to talk to anyone but Joy! LOL :clock:

I'm sure yours was ready the day after mine was. :D it not the same day. You now I've said this before but we really need to complain to a supervisor about these people. We can't just keep quiet and put more stress on ourselves, it's jut too much and we need to put our foot down. When you were gone a VJer called and I forget her name but Joy's twin made her cry but she complained about this CS rep and that is what we should all do. I will if I get someone nasty. (F)(L)(F)

I have a question.... After reading all this TAX HUB-BUB... has anyone filed single and got denied at the interview?? I didn't file married , I filed HoH as I always do and mine was accepted No Problem. I just want to know what the big friggin deal is... all they really want to know is if you make enough money , right? I mean... is it really worth all this hassle of filing married when they aren't even living in the US and don't have a SS#??? I don't mean to sound like a wise-a$$.. I just have been wondering this for a long time.

For me personally, I'm not filing married until he is here and is working and has a SS#.

Funny, that was exactly my thinking when I first came to VJ, tax forms are only used to verify your income and filing status should not matter for visa purpose. I still think it doesn't matter much but regardless of the visa process, I learned here that it is still a requirement to present correct information to the IRS. Also, I read in other forums and from Saylin that it might not be a big deal, except for applicants in MENA countries at time of interview. Afroukhs's husband is applying in Morocco, so I would lean to be on the safe side in her case. Not sure about HoH though, I never had to research that one.

One thing is for sure, every time someone posts a tax question anywhere in VJ, it is bound to create a heated discussion :D

03/17/14 - DS-261 completed. Email Confirmation received

03/19/14 - Requested NVC to "join" wife's and daughter's cases
03/20/14 - AOS status "PAID" for wife
03/26/14 - AOS status "PAID" for daughter

03/28/14 - IV available and paid for both wife and daughter (in process)

04/07/14 - Civil docs arrived via DHL from my wife. IV packets sent (Finally!!)

05/07/14 - NVC shipped case files to Lima Embassy via DHL. CEAC status "In transit"

05/09/14 - DHL delivered case files to Embassy. CEAC status "Ready"

Well my accountant told me that if I amend my return after the wify got here then i'll be in trouble with IRS because they will know that she didn't come here in 2013 so there is no point to amend it.

I filed as HoH too and not worried about this.. *crossing fingers*

I am almost 100% certain what your accountant told you is not true. Almost everyone who files as MFG with spouse's SSN as NRA end up amending it and file MFJ after spouse arrives in the US and has a valid SSN. This results in much bigger refund as a result. Someone please correct me if wrong.

another month and it has gotten worst ! husband and I been fighting like we hate each other :( he had asked for the divorce a million times then we been trying to make it up and we can't be good w.o fighting every 2 min :( idk wat to do anymore i love him but he doesn't seem to care about this anymore! when we fight he left our case out as if he was doing it to hurt me he doesn't wants to cll nvc or do anything! we already paid the I864 fee and thats all we have done we are in troubles besides fighting everyday he had to amend his taxes and now he haven got the amid tax back so we can't even put together the AAOS PACKAGE :(

not to mention he owns IRS $300.00 for filling wrong his taxes : :( this sucks almost two years of this bs and we are losing it ! someone help me do we need the amend forms to send the package :crying:

I'm so very sorry sweet heart, this process is so difficult that it takes it's toll on many who go through it.

I am presuming your in Panama and he is in the USA? I wish there was a way for him to visit you even if

it's just for a week or two. It might be enough to put things back on track and for both of you to remember

what you have despite the process. We sometimes forget what we have and can see only the moment.
