I am betting 100% that they will just request that you also submit a full I-864 because every petitioner must fill one out, regardless if you have an income or not.

So when I do my own 864, it would be by itself and wouldn't use 864(a) because my dad already submitted another a separate 864.

Yes, you submit your own 864, referring only to you as the petitioner (ie main sponsor). It's kind of a technicality, because obviously you don't qualify financially, but they need the form from you anyway. They might eventually checklist you and make your dad fill in an 864a instead, if, for example, you live at home and he claimed you as a deduction on his taxes, which makes you technically part of his "household". I've heard of it happenning. But I think you'll be ok with his 864 and yours.

Question on AOS and possible checklist-

I am the petitioner but I do not have any income. I did not know that the affidavit of support has to have the petitioner on it.

So I just had my dad fill out the AOS on his own (that is he being the only joint sponsor). Now when my packet gets reviewed (scanned by NVC on 05-19) what do you think they will ask me to provide with? I did not file my taxes for 2012 and 2013 since I was enrolled in school full-time and did not work.

Any suggestions/ thoughts as to what would happen ? Your response would be appreciated.

You will get a checklist. Both of You should do I-864. Your dad too...do not fill I-864a for him.

You can go on IRS website and download a document saying that you did not file taxes. Follow the steps for IRS Tax transcript and click on 2011,2012 and 2013 to download these document. Send them with the form with a written explanation of why you did not file taxes.

OOOOOH! What good news from folks!!! It's early morning here in Australia, and I see that my L-Girls all got great news overnight. Wondering if LindyStephan has checked in (he can't be an L-Girl - well, maybe an honorary one....), as he's in the same date-range as the rest of us!!!

I have to have breakfast before calling - I'm one of those people who need to eat first thing in the morning...it's only 5:15 p.m. in New Hampshire, so I'll have plenty of time to eat before finding out if we have an interview date.

We had originally booked to fly out of Australia on July 7th, because we figured on an early June interview. But because NVC screwed up our case, that date is really not possible.

Also, we're taking our grandkitty back to the US with us - and that will change how we get back to the US (we normally stop in Hong Kong for a few days - but no stopping now!!!) and I've been on tenterhooks because I have to rebook flights for us AND make sure we can get the cat home at the same time!

I'll check in later to let you know what happens!

Guys how long does it take to download tax returns from IRS? We have to fill 1040 form and then how long after that will the returns be available?

Just got off the phone with NVC rep and they told me they haven't received my petition from USCIS yet!!! My petition was approved on May 27th and USCIS sent it on June 3rd. is this normal or should I be worried???

Mine took about 20 days seemed like an eternity so don't worry it will be fine.
