I am beyond frustrated! Still no sign of an interview date since the 8th of May! Just called and got the usual "30 business days" gist.

Anyway, my question is this fellow filers: do I need my full medical history or just my vaccination record from my GP?

Also, could you give us more info about you with maybe a signature or complete a timeline? Like where are you supposed to have your interview? Its just helpful for others waiting and also we can help you better.

I got a false check list the day after my AOS was approved, so I would assume it takes about day whether it's real or false.

I learned that we got a check list on May 30th, we still haven't received any email from them. I called them on the 2nd of June and said it will be received in a few days but still nothing as of today (5th of June). Should I be worried?

Me too. I spoke to Jean? last night who said someone was "in my file" and she couldn't get it, which meant it as being reviewed (AOS received May 9th). This morning I called again hoping they had finished review and I spoke to a grumpy Fiona who said, "you need to wait a FULL 30 days for review Ma'am!" Boo hoo :crying:

Lol i see that the grumpy people work in the morning. Most vjers have had the same experience. Maybe tonight is our night?

I just finished the call to NVC, asked them about my IV Invoice. The old man very nice to explain to me something( I said "old man" because I guess on his voice :) ). At first, my IV Invoice will be available no later than this week as he can write a note or do something in my casefile. He said IV Invoicing now takes longer than normal due to backlog. For those who submitted DS-261 twice or more and nothing changes on the form. He said that is website error and NVC knows that. They process on the first submit if the form is the same. He answer that when I ask which date I counting to 30 days......So, in my case, I counting from May 8( first submit) but he assured as I wrote above, maybe he is a supervisor :). And the second, AOS and IV. He said today NVC reviewing the package that has been scanned into the system on May 9 and a bit 12. My AOS package scanned on May 20, he also said I may have update on AOS Package in the end of next week.

FYI : I dialed 38 times and on hold for 72 mins :)

So what date are they on right now? Anyone know?

I think they are working on mail from May 9th. I spoke to someone early morning in USA who said she couldn't get into my file becuase someone was looking at it at that moment. But, when I rang back 5pm USA time, a rude lady said it is still under review and that I need to wait the FULL 30 days.

As long as you qualify for HOH, then that's fine for this process. That and filing MFS and MFJ are acceptable tax filing statuses. The only one you can't do (or shouldn't do) is filing as single when you're married.

I believe its ok, I recently took a tax class and I learned that married person can file head of household if he/she meets the criteria such as leaving separate residence from spouse, qualifying child and support test. As always please read more on the IRS website.

Also if ever you decide to file an amendment to change to Married Filing Separate status, I would recommend using the assistance of tax professionals. There are tax credits/ deductions that you cannot take if filing MFS and if you filed Head of Household, most likely you took those tax credits/deductions on your 1040 so you will have to change that as well. This is why most tax people will advise you not to file MFS because it gives most people the least advantage/benefit.The amendment process usually takes about 8 to 10 weeks.

You submit a 1040X to amend the Filing Status to Married Filing Seperately. That way your 'foreign' spouse does not have to sign the form. This is a very simple form and you can do it yourself. After you submit it (you have to mail it) to IRS, include a copy with your AOS package and also carry to the consulate for interview, in case they want to see it.

I really hope tonight is our night! If you call, please post what you find out. I won't be calling again for a couple of days. I am dying to know if I have a checklist or not, it is making me sick to my stomach thinking I might have to tack on another 30 days. My poor family in the US is patiently waiting for our move date and we can't do anything until we get this visa. When we applied for the I-130 in June last year, I was so naive and thought we would be there by Feb 2014. Ha! At this rate I feel I will be lucky if I get to spend Christmas 2014 with my family.

How can a petitioner establish a domicile?

When a sponsor has clearly not maintained a domicile in the United States, he/she must re-establish a U.S. domicile to be a sponsor. The aspiring sponsor may take steps, including the examples given below, to show that the United States is his/her principal place of residence

  • Find employment in the United States
  • Secure a residence in the United States
  • Register children in U.S. schools8
  • Relinquish residence abroad
  • Other evidence of a U.S. residence

If the sponsor establishes U.S. domicile, it is not necessary for the sponsor to go to the United States before the sponsored family members. However, the sponsor must return to the United States to live before the sponsored immigrant may enter the United States. The sponsored immigrant must enter the U.S. with or after the sponsor.

The cover letter I remembered reading is on Saylin's wiki... LOL I've been reading so many things it's getting tough to remember what I read where!

You can get an idea from people whom have already had their interviews and were successful and those who were not. They explain all the documents they used. got access to my IV application today and fed-ex'd the IV packet this morning. i'm a bit worried because as i was putting the packet together i realized my husbands name is missing a letter. he's been using this birth certificate for years like that. i sent it anyway and hope it doesn't cause problems. It will be difficult to get another one from Congo since my husband is not there any more. My husband is currently living in Russia and there's no embassy there. the closest he says is in Ukraine but that isn't a great option at the moment since visiting there is dangerous. I pray no one notices. in the meantime i'm going to see if one of his relatives can work on getting another birth certificate in Congo. i hope it doesn't delay things.
