Here's what I sent it, and I was approved at NVC: (though I've heard Canada is pretty tough with this)

Supporting Documents for the above steps I have taken:

• Absentee ballot request marked “US citizen, plan to return”

• ************** Credit Union statements showing permanent US address

• ***************** investment fund statement showing permanent US address

• ************ retirement fund statement showing permanent US address

• Copy of state drivers license showing permanent US address

• Lease agreement for our house

• Quote from auto insurance company regarding my request

• Quote from health insurance company regarding my request

• Bill of sale for car purchased in the USA

• Email about inquiry of renewing my teaching license

• Email correspondence with international shipper giving quote

Sounds pretty rock solid to me... especially the drivers license with US address

Hi thanks for your response :-)

Re-establishing domicile list includes:

Maintained voter registration number (my husband "believed he sent in an absentee ballot, but apparently did it wrong so we couldn't use that as proof)

Newly renewed US drivers license

CRBA's for children

US passports for children

Letter from mother-in-law/joint sponsor stating we will be living with her until we get our own place

Correspondence from schools discussing enrollment of children

Moving quotes from Upack and another local moving company

Job letter from father-in-law stating my husband/USC will be working for him ( wondering if this will be a problem because my husbands current title and field is technical analyst, but his father is a who builds houses. The document states my husband will be an assistant carpenter. Will this be an issue because my husband does something totally different now? He will only be working with his father until he gets a job in his field in the US.)

Maintained social security number

Resignation letter from petitioners employer stating they are aware he will resign once visas are granted

Documents showing permanent US address

Bank statements from US bank account showing that it is still open and being used

This, i think, is all for now

Hi Rielle09... The Drivers license is an awesome one to have, wish I had that but still living in Canada with my Canadian drivers license. How did you get a US license without moving there first?

The resignation letter from petitioners employer is a great idea, I may add that to mine as well!

As far as I understand it, you can establish domicile while not living in the US if you can prove either:

A - you left the USA temporarily with plans to return

or

B - you plan on re-establishing domicile before or at the same time as your loved ones

with me it is a little of column A a little of column B, but since it is 12 years I've been living in Canada with my hubby I am leaning towards B. When we decided to live in Canada, his mom was just diagnosed with Ovarian Cancer and it made sense to be close to his family (it was also RIGHT after 9/11 and I lived in NYC at the time) but there was always the chance we could move back to the USA one day. 12 years later she is cancer free and I would love to be closer to my parents. His parents are excited at the idea of visiting us every winter to escape the cold ;-)

  • I've maintained bank accounts and credit cards at their address in North Carolina, gotten stuff mailed there for years
  • US Passport and Social Security Card
  • Moving quote from UPack and PODS
  • Possibility of a Job Transfer (I work for Home Depot so HR is getting back to me on this)
  • Sale listing for our house in Canada
  • Rental lease for the basement of my parents' house
  • Declaration of my plans to cross the border WITH my husband once he is allowed to move to the USA (we've never been apart in 12 years)

Of everything in this whole process, domicile is what I am most worried about so it is great to hear how other nonresident USC's are approaching it!

Which do you think my evidence proves? A or B? Funny enough, my husband is from SC and we'll be moving there once we get our visa and then to NC once we get jobs there. Edited by Rlelle09

I would say your evidence leans towards his move being temporary if he never even changed to a Canadian license at all... how long has he been in Canada? (keep in mind I'm not an expert either, just figuring things out)

There is a cover letter somewhere on VJ... I'll have to find a link to it... somebody put together a list of all the different types of things to include regarding domicile

Just spoke with Ivette these were her answers:

- No interview yet;

- They are still scheduling;

- The schedule only depends on the slots each embassy has for Visas Interviews;

- No time prediction (no month mention)

- An e-mail will be send with the date and time of the interview.

Basically the usual, except that she was being cautious about not letting a month estimate come out.

I guess it will be the waiting game for the Paris Embassy goers. :clock:

I'm stumped with a DS-260 question that is forcing me to lie: "Have you ever served in the military?"

I did get basic training in the US and served in the US military during Desert Storm to liberate Kuwait. When I answer "Yes" and try to select the country name, USA is not included in the drop down menu!!!

I'm thinking of answering "No" then explain the issue in the cover letter and include an official affidavit issued to me from the US Embassy back in 1991.

Any better suggestions?

PS. Strangely enough, my wife has the same issue as well.

PPS. The DS-260 form did not ask for Beneficiary ID Number, contrary to the pdf sampler.

Is Kuwait an option? Does it let you give an explanation for that question?

To your PPS, that must have changed VERY recently because my husband needed it when he did his DS-260 a couple weeks ago.

Just got off phone. DS 261 hasnt been put in system and shows complete as of may 30th.

He said AOS package was still in delivery room? Lol And to check back on that tomorrow.

You have to call them and find out about the DS261. Once you complete the form it will say completed. That does not mean they have reviewed it.

Mine says complete too.

However, when you talk with NVC operator, you can ask them like, "Does my DS261 on a case file?"

And the operator will tell you, "it is waiting to be reviewed"

Is Kuwait an option? Does it let you give an explanation for that question?

To your PPS, that must have changed VERY recently because my husband needed it when he did his DS-260 a couple weeks ago.

Interesting. My ds260 didn't ask for the Beneficiary ID# either, and I filled it the same day as your husband xD

You sure he needed it?

Who knows, maybe this is something that also changes depending on the applicant. (like the employment and education part xD)

If I select Kuwait, I probably will get a checklist for not providing an official military record from Kuwait where none exists. Answering "Yes" only triggers on fields for rank, service and from/to dates. No text field for explanations.

Regarding the BIN, I only tried my form. I haven't started yet my wife or kids' forms.
