You should verify the conditions for in-state tuition. Some people here in VJ say that you qualify for in-state tuition one year after getting the green card.

This is what CUNY writes on the page about in-state tuition: "

How do I qualify for in-state tuition as a student with immigration status?

You qualify for in-state tuition if you have resided in New York State for at least one year AND one of the following:

You are a U.S. citizen, permanent resident, or have a permanent resident application pending. (Note: You must have filed a Form I-485. Having a pending or approved I-130 or I-140 petition is not sufficient; or

[.....]

If you maintain lawful F-1 status, you can only qualify for in-state tuition if you apply to become a permanent resident by filing USCIS Form I-485 (Application to Register Permanent Residence or Adjust Status) or change to another qualifying status. "

So, even though one of my advisors said she thought I needed my EAD card it looks like as long as I have a pending I-485 I can apply for in-state tuition. I've lived here for 2.5 years and I've been maintaining my F-1 status all along.

AOS from F-1, maintaining status

August 2010 was introduced to each other during a visit in NY.
01/14/2012: Arrived at JFK with F-1 visa with the intention of studying for three years, and then do OPT. Intention was not to get married!
Yet, almost five semesters as a full-time international student later he proposed ...

04/07/2014: Married in Queens, NY

06/26/2014: I-485, I-130, I-765, I-131 and supporting documents sent to Chicago Lockbox via USPS Priority.

06/30/2014: USPS states delivery happened 6:50 am.

07/07/2014: Received NOA of I-130, I-485, I-131, I-765 dated 07/02. --- What a great 3-month anniversary gift!

07/15/2014: Received Biometrics appointment scheduled 07/31, in Long Island City.

07/31/2014: Biometrics done. Process took 45 minutes. 99% was waiting time. Awesome people working there. Good experience!

08/06/2014: Case i-485 updated to Testing & Interview on uscis.gov - - Yay!

08/29/2014: Updates on I-765, card in production as well as I-131.

09/04/2014: Update on I-485, interview scheduled for October 10th, 2014.
09/08/2014: Received combo-card. Went straight to Social Security office to get SSN.
09/15/2014: Received Social security card in mail.
10/10/2014: Interview at Long Island City. Took no more than 10 minutes. Was simple, normal questions. Was approved on spot.

ROC

10/07/2016: USPS stated I-751 was delivered. Also sent in fee waiver request.
10/19/2016: Got everything back, with denied fee waiver. They misspelled my name. Makes me wonder if they even read my application. My name is all over the papers.
10/25/2016: Sent in ROC (I-751) again, with USPS.

10/29/2016: I-751 delivered again.

Hi there,

Please go to see your international student advisors and show your receipt of I-485 to them.

They are going to change your status probably. Once you submitted I-485, you are not technically an F-1 student now.

Additionally, in order to qualify for in-state tuition, I heard that you and your spouse have to pay taxes more than 1 year. But please confirm this with your advisors. Good luck to you!

04/11/14 - Day 00 - Mailed AOS package; I-130, I-131, I-485, I-765

04/21/14 - Day 07 - Notice by text and email

04/24/14 - Day 10 - Hard copy of NOA1

04/28/14 - Day 14 - Hard copy of Biometrics

04/30/14 - Day 16 - Walk-in Biometrics Done. Actual appointment date: 5/15

05/19/14 - Day 35 - I-485 status changed to "Testing & Interview"

06/24/14 - Day 71 - EAD Card in "Production"

06/25/14 - Day 72 - I-131 Travel Document in "Post Decision Activity"

Thank you, that was indeed also what I was going to do. I'm sure like with any other administrative thing in CUNY that it won't go as smoothly as I could hope for, but I'll bring the receipt of I-485 and keep trying. I still have until August 27th to pay the bill so hopefully I'll get the NOA way before that.

I never heard about the taxes, nor was I able to find anything regarding that in any of the documents I found on the CUNY system so hopefully that's not the case here. If so, then the pending I-485 or EAD means nothing because I'm graduating in December. But I want to continue with my master's in January, so I would love to qualify for the in-state tuition then.

hey I'm a former CUNY employee and alumni, as a matter of fact I'll be returning this Fall or Spring semester to continue my studies all depending on how timely my application gets approved. In regards to the policy im not sure that is still effective cos they usually would wanna see the physical Green Card in order to terminate ur SEVIS and qualify for instate tuition. You wanna cross check thoroughly with ur campus DSO and if u can share the link... Goodluck on ya journey!!

We will probably be in Chi-Town that day, so we went in for an early walk-in. The office was literally empty, so we got it done in less than 15 minutes.
