June 2014 AOS filers

Hi Guys,

I am joining this forum late. I filed my husbands AOS on June 09th our NOA 1 has a date of June 11th, 2014. We received his biometrics letter a few days later his appointment is scheduled for Monday 7th July, 2014. We tried to do a walk-in at Forth Worth ASC and it was unsuccessful they will not process you until your actual appointment date. I am not able to check our case status online it says case status not found. So I am just going through the motions I cannot wait for this to be over! We live 2 hours away from Froth Worth so we will have to drive all the way back on Monday.

It's posts like this that make me have second thoughts about doing early walk-in biometrics. Maybe I should just wait for my appointment?

On a related note, does anyone know if doing early biometrics speeds up the EAD/AP process?

Totally. Within 2 weeks you should get your NOA 1 and another week or so biometrics appointment letter. I am in forest hill too. Hello neighbour ;-)

no, it doesn't, but if you are planning on expediting the EAD based on a pending job offer, then from what i understand, the request can only be approved once biometrics has been completed.

Some ASC allow walk ins but not forth worth I wanted to expedite my husbands EAD also but I was told it may prolong the process instead of speeding it up so I decided to just be patient.

did he have a job offer? putting in a request to expedite the EAD based on a pending job offer should not delay the process at all. the worst thing that could happen is they deny the expedite request and the EAD process takes the normal amount of time.

FWIW, i got a job offer yesterday and i'm putting in my expedite request tonight fingers crossed and i'll keep you guys updated if anything moves.

actually you sent your AOS packet to the wrong address!!!! The address you sent it to is for those sending their documents through FEDEX/DHL/UPS etc. For those sending via regular USPS there's an address for it which is USCIS P.O. BOX 805887, CHICAGO IL 60680. I'm sure USCIS have their specific reasons for separate addresses depending on what carrier your using and it's prolly the reason why your package has been in limbo. Hopefully they reroute it to the right address.

Yes, it is not correct address for USPS. But someone here also sent his AOS package like John&Jeanie did and USCIS accepted though it would take a while for them to get status at acceptance stage. It will slow the process, I guess, but in my opinion USCIS won't send back to package just because people sent it to the wrong address. anyway, most people here have a delay of anywhere between a few days to a few weeks from package delivery to acceptance by USCIS. it's normal, especially given it's a long weekend and many workers may be on extended vacations. don't worry john&jeanie, i'm sure all is fine!

Yeah, the signature thing might be the reason. I am completely agree for that.

Just chiming in, but we're still waiting for the notification of acceptance, NOA1 etc. Very glad that we chose to send it via certified mail, so at least I know it got there!

For people who are interested in the reason to my RFE.

1. Sweden do not have birth certificates, we have "Personbevis" instead. In my package we sent a copy and not the original which has a stamp and a signature. Bad move.

"Available. Birth records for persons born after July 1, 1991 are called "Personbevis", and are issued by the local office of Swedish Tax Agency (Skatteverket), covering the applicant's place of residence at the time of birth. (If place of birth is unknown, apply for the birth record through 'Riksregistret' at the Swedish Tax Agency.) The complete version should state the applicant's date and place of birth, the names of both parents, their marital status and their date of marriage, if applicable. Birth records for persons born before July 1, 1991 can be obtained both from the parish office (Pastorsambetet) in the parish of the applicant's birth and from the Swedish Tax Agency (Skatteverket)." - travel.state.gov (http://travel.state.gov/content/visas/english/fees/reciprocity-by-country/SW.html)

2. Our joint sponsor, according to USCIS, does not meet or exceed the 125% of poverty guideline. Absolutely bs. In our package we submitted the latest tax return and te W2 where the sponsor makes over $500 000, however, they file joint tax since they are married. This is clearly indicated on the return. We therefore included the W2 which has the same number. Apparently that is not enough for the USCIS.

"The joint sponsor's income on the Federal income tax return does not meet or exceed 125% of poverty guideline. The joint sponsor list their current income on Form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of income."

However, I guess I can be as upset as I want regarding point #2 but our mistake when it comes to point #1. I have to gather some documents and reply on monday. I am still quite amused that over $500 000 on the tax return and the W2 does not meet or exceed 125%.
