Hi Guys,

I'm wondering if any of you astute people would be able to help with my enquiry.

I recently filed I-751 Form to remove the conditions on my CR1 visa to the Vermont office. It was returned today with the following comments.

"On your I-751 Petition to Remove the Conditions on Residence, it appears that you have either reversed the names of the conditional resident (petitioner) and/or spouse/parent, or you have listed the same name in both sections"

I was recently divorced from my USC wife after 3 years so I am filing this petition separately.

I filled out section 1) on the I-751 (Information about you, the conditional resident) and I also filled out my name in section 3) on the I-751 (Information about the petitioning spouse, or if filing as a child separately, information about the US citizen or LPR stepparent through whom you gained your conditional residence).

Am I correct in thinking that Section 3) is normally the section a USC would fill out and I should have left this blank?

Any help on this is massively appreciated..

Hi,

First of all, I have no experience with I-751 waiver filing.

I try to look at the latest I-751 form.

Part 1. : Information About You

• Alien Spouse Information
Part 2. : Check 1d box.
“I or my parent entered into the Marriage
in Good Faith, but the marriage was
terminated through Divorce or
annulment.”
Part 3. : Information About U.S. Citizen
Spouse
Relationship: 1.a. Spouse or Former Spouse
==> It is information about your former US citizen spouse.
Part 4. : Information About Children of
Alien Spouse
Should be blank if you don't have kids.

So as I thought, it has been referred back to me because I filled out Part 3 as well and should have left this blank?

Part 4. I left this blank as there were no children.

I think you still have to fill up Part 3, information about your former US citizen spouse through which you got your Green Card from.

Your I-751 was returned possibly because you filled your own name in Part 3, instead of the US citizen spouse name.

Then in Part 6. Signature,

You would only fill up Signature of Conditional Resident (1.a, 1.b and 2.), NOT 3.a, 3.b and 4 (because you are not filing jointly).

Would I also have to fill out part 7 as the preparer?

Is anyone able to confirm that Part 3 needs to be filled out (with regards to your former USC husband/wife) if you are removing the conditions separately? or is it left blank?

Just put "unknown" .

For SSN#, do you still have your previous immigration paper work? Her SSN might be there somewhere.

Otherwise put "unknown"
