Not married yet and having a baby soon. Which is best K1 or K3. PLS HELP

Hi. Last year I met the love of my life. I am a Filipina and my fiancé is an American. We've dated for almost a year now. We met here in my hometown. The love we have for each other brought us this little bundle of happiness growing inside my womb. We are having a baby! Of course my fiancé's family is super excited to meet me and my baby. Especially that my fiancé is the only son. Now we are not sure what to do next. Should we get married first here so I can apply for spousal or we should wait and file for fiancé visa first? And what about our baby? Pls if anyone knows about this topic pls shed some light to our questions. Thank u so much.

Hello, I am CR1 (spousal visa) and waiting for our case close from NVC so that I can proceed to my medical.

Congratulations, baby is coming very soon.

It's up to you and to your fiance of which visa you would to apply.

You can apply as K1 and your baby is k2.

You can also apply for CR1 (spousal visa) for you and the baby will be automatic as USC. Here is what to do for your baby once you give birth. Apply her/him a CBRA, meaning to be a USC, you will apply this at the US embassy manila and you need to keep all her/his records like hospital bills, birth certificate, and documents from her/his USC father.

Submitting the I-130 Petition to put you on the track towards an IR-1/CR-1 visa (spousal) minus the added paperwork of submitting an I-129F for a K-3 which would administratively get closed anyway -- would mean one less document to fill out. K-3s were done at a time when IR-1s were taking more than a year to complete -- that's no longer the case, especially for an applicant in the Philippines.

The advantage to getting married (IR-1 visa) is you'd get your Green Card shortly after arrival vs having to wait months in the case of a Fiance(e) visa.

Whichever way you decide -- good luck!

Thank u for ur response, I really appreciate it. So you're saying a fiancé visa is the easiest and fastest way? Since baby will have his own passport after filing for a CRBA. Others suggested we qualify for a DCF since my fiancé is here with me. He just arrived from the US today actually but he lived here for almost a year from May 2013 to April 2014, went back to the US and came back again.
