No Houston sucks big time. I heard Florida is good so look that way.

oh come on, LuckyTXN - at least I'm not recommending Houston ! Maybe I should recommend Houston - Operator might meet up with some fella here and change the landscape again !

oh come on - don't you want to see Operator's wife owning 10 nail salons and 12 massage parlours between Houston and Dallas ? Along with 4 or 5 'pregnant mother' luxury hotel-houses ? All these are big ticket items this year.

Yeah I guess we could use a few hundred more of them. I do have a new property site I am about to list so...

Denver is wonderful -- just got back from a weekend there. It ticks a lot of your boxes except the warmth one (at least year round), and it's definitely more affordable than the Bay Area. Mr U has occasionally floated the idea of moving to Albuquerque, but it's a pain to get to flightwise from our respective parental units' homes. Have you considered the San Diego area? Northern SD County is GORGEOUS -- lush landscape, tons of outdoorsy stuff to do, cute little town but only an hour or so from San Diego proper. I love Fallbrook, which is just east of Camp Pendleton. Very friendly little town with a thriving arts community. I'd advise against moving to LA unless you're in the entertainment biz or hate yourself overall like I do.

There is a good possibility that our situation may have us moving back to the US this calendar year.

I need to know the best city to live in and why...please, your helpful thoughts are appreciated.

Atlanta has a pretty strong Korean population and therefore grocery stores. I know it's not Chinese but my wife really likes them. She wants us to move there. North Atlanta is pretty affordable as large cities go. Their job market isn't bad either. Lots of good opportunities and affordability in Texas too. What size city and amenities are you looking for? Does she live on Chinese pretty much exclusively? Prob have to go west coast if she can't live without authenticity and variety.

i'm a huge fan of Irving, Texas,

as

1. DFW airport is right there

2. South Irving Cheap to purchase 1.4 to 2.5 acre spreads in town

3. Huge Chinese Community

4. Excellent Asian Markets in town

5. Texas has no state income tax

6. Dead easy to set up a company, even online with the state comptroller's office

7. Warm 10 months out of the year.

8. The illegal aliens are moving out of Texas, they cannot find 'regular' work

9. EVERY one of the Fortune 500 has an office in North Irving.

10. North Irving full o culture.

I lived there for 2 years, would live there again.

Texas has been discussed but in terms of San Antonio or Austin. I know the Dallas area is sprawling, thanks for the input.

No stay out of Texas. Git.

Giddyup!!!

Denver has been in my heart for years, my big sister lives there and the only reason I work really is to ski occasionally. I'm still pushing for Denver. I like San Diego and I was stationed at Pendleton in 89'-90' and I had an office in Riverside (Yeech). My middle sister lives in La Jolla (la-de-da) but she can afford it...

The ABQ would be cool, I could start cooking meth...I wonder what Badger and Skinny Pete are up to? Seriously though I need to check out the South West.

I've lived in the SE for most of my life. Atlanta has areas that I would consider and it's close to family and friends and I have considered it. The company she works for now actually opened an office there two years ago. She's not dependent on Chinese food and can go periods of time without it but aside from fresh ingredients you can order most everything from the internetz! Another SE city I wouldn't mind living in would be Charleston! Hmmm...

Yeah ABQ or all of NM would be a bad idea and besides you said the need for an International airport. Colorado I lived in the Springs a few years and love the sights and beauty but unfortunately the people there made me happy to move. My brother lives there also and nuff said about that.

I do love the southwest myself to visit and I have thousands of pics all over the southwest but honestly I could never live there. I suggest before you attempt it to visit for an extended period of time to see what I mean. Phoenix is the only city worth noting so be prepared for extreme high temps and the derranged personalities that occur because of that. Of course if you like Atlanta and think that is a good place to settle into then by all means check out Phoenix. Maybe Flagstaff but it does get extreme temps and the winters. Maybe since you adore skiing then maybe think about Salt lake area. Many plusses in that area but of course you would come into contact with Mormons and nuff said about that. If you are Mormon then you understand completely why I say that

I do know about every part of the country somewhat so if you post more on what you are wanting I can possibly help point in the possibly right direction.

So what's the answer and why, o Crim Pro goddess?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So what's the answer and why, o Crim Pro goddess?

The answer is C, or at least that is the least worst answer. :)

Not A: Not a violation of knock and announce. They waited before entering.

Not B: Whether or not he had a chance to open the door is irrelevant. If they knocked and announced, waited a reasonable period of time (usually 15-20 seconds), they're fine.

Not D: There's nothing pointing to inevitable discovery. The police would have to show by a preponderance of the evidence that using reasonable police procedure, they would have discovered the cocaine anyway. There's no violation of Darnell's 4th Amendment rights (assuming there is a valid search warrant), so the search itself was valid.

So it's C -- that rule is correct. Even if in some way the warrant wasn't executed properly (say, there was no announcement even if there were a knock), that isn't a reason to exclude items properly seized pursuant to a valid search warrant.

The answers have all sorts of problems to them. C was the least terrible among them.

Once I was blind, but now I can C, man.

I would have wild-hindquarters-guessed C or D, in that order of preference.

I wonder how often people's lives or reputations get ruined consequent to bad publicity even when a bungled warrant/search/arrest is thrown out by a court.

And the Fourth Amendment is on life support, perhaps just a couple more bad Supreme Court decisions away from pffffffffft.
