Good Day All - seriously in need of help!

My husbands ROC's timeframe is coming up and I'm collecting documents. This immediate issue I am facing dwells down to two specific areas where I have seen others receive RFE's - Residence and Joint Accounts.

Currently, only my name is listed on both our bank account and our apartment lease. Now, we will be opening a new account and signing a new lease right after his ROC's timeframe opens. However, I really dont have anything specifically for the above mentioned requirements. Suggestions?

Can you ask your landlord to write a statement saying that you have been living together in your apartment?

Also, does she have any legal documents (maybe state driver's license or ID) that list that address as her permanent legal address?

Open new accounts and sign new contract by the time of filing ROC will raise red flag because they are too recent, and it will result in RFE and/or interview.

1. Landlord/ Apartment leasing office can make a headletter to certify your communual residence.

2. You explain why you two doesn't have bank account on the headletter of the package.

As far as documents with his name and address coming to our aparmtent, I have plenty I plan to send - Utility bills, W-2s, Driver's License, Health Insurance/Medical Bills. I also have documents from mine (and trying to get his) job showing each other as beneficiaries on health insurance and my retirement fund.

Unfortunately, my landlord will not write a letter stating it was a communal residence because he was never added to the lease.

So, really I'm just trying to overcompensate in any other areas to try my hardest to prevent RFE. I'm not sure if it'll work, but I can at least try.

Any other suggestions are greatly appreciated.

Hm, that doesn't seem very friendly of your landlord. All your utilities, DL's, etc is very good. In your cover letter I would say exactly what you said here as well- that your landlord wouldn't write a letter stating communal residence for the time frame because your husband wasn't on the lease agreement. Maybe if you have neighbors you know well they can write up something for you that will support your statement.

I agree that opening a new bank account right now might be a little fishy, but if your lease is up anyway go ahead and add him to the lease. It will only help your case.

Also any other assets you may have together, such as car titles (which are very easy to go to the DMV and add a name to), would be very helpful.

Don't stress. It seems like you have a lot more than some other people applying from this site.

If you have all the other great supporting documents which seems that you have, maybe you can get affidavits from people who can testify that you live together. Worse comes to worse you will receive an RFE, by that time it seems like you will sign a different lease, so that might be a game changer.
