Why are rules different for F2A spouse & H1B spouse visas ?

Hello all !

This is really annoying badly :(

My priority date for F2A spouse visa is nov 2013 as I see in forums every one are saying it might retrogress to May 2012 which is a bad news for August/sep/nov priority dates ! Any way I have a question why can H1B holder can take his spouse as soon as they are married & where as a green card holders spouse need to wait for ages ? I see lots of Indian men just coming here & marring there spouses & with in couples of days they are granted visas :( & all this ppl go there & do all illegal stuff ! Ppl who are genuine like us need to wait in a long queue for ages !

USCIS should change the rules for spouses of green card holders !

It's very hard staying apart from my wife we been married since 1 & 1/2 year ! & one more thing a green card

Holder can't leave the country for so long ! So every time my wife visited me she need to go back again as we need to worry about her green card ! This are really a rules :(

Because one is an immigrant visa and the other is a nonimmigrant visa.

Your post made you sound a little racist, so it's hard to find a lot of sympathy for you I'm afraid.

Day 341 (12/10/18) Interview was scheduled for 1/14/19

Day 376 (1/14/19) Interview

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX

you are comparing 2 different things, the visa bulletin has retrogressed for June, this is very common

the H2B is a non immigrant visa and it is allowed to bring their spouses, but they aren't applying for a GC, at least not at this point the employer isn't applying a GC for them.

you have filed for a GC for your spouse. 2 different things

I agree but even H1b visa holders will apply for gcs ! Do you really think this ppl will go back to there countries ?

But my point is the rules should be same for green card holders spouses ! Uscis should allow gcs spouses in country & then wait there for gcs so that they can be with there wife/husband
