I-130 petitioner marrying citizin

Sorry for late reply, yes I have been in the US for the last 3 years and I was on a student visa. But that has ended but we applied for the I-130 before it expired. So all applications and paperwork was send to the USCIS before that happened and they saif it was fine to stay as long as I applied

Who told you that it was fine as long as you apply?

You either misunderstood the person or that person made a mistake.

You're the over 21 years old unmarried child of a USC. This means you are in the F1 family preference category where a visa number will be available for anothe 7 years. You do not qualify to adjust. Your AOS will be denied and you will be deemed to have overstayed your student visa.

Unforturly, you got bad info.

At this point, marrying a US citizen is your only lefal way to stay and get a green card.

That was my initial thought but when we spoke to the USCIS (for a few times) they said it was ok and they also told us to write an expedite letter to speed up the process which we did and they pushed my paperwork forward and got it done. Once it was sent to the NVC we also spoke to them which they said all we can do is wait for the priority dateto continue.

There is your problem. You took advice from the USCIS misinformation phone center.
