Hi guys,

I am trying to figure this out but I figured it's better to ask the people here instead of googling the answer and get different ones.

I've read about priority dates and what they actually mean.. But how does it actually work?

For example, I am the spouse of a U.S citizen, so I am the beneficiary, we filed our I-130 and got our NoA 1 on May 6th.

When filing a I-130 for a spouse of a u.s citizen, not a permanent residency holder, is there a difference?

Do I need to wait for my priority date before I can get an interview? And what would my priority date be? May 6th?

I went onto the american embassy site for Sweden but they don't list any information about immigrant visas, only non-immigrant ones, but looking at the timeline for other swedes, it looks like there's 5-6 months of wait time before I get an interview date, is that because of the "priority date" thing, or just because they are busy over there?

I've read somewhere that Spouses of U.S citizens are not under the priority date queue, is this correct or is this false?

Thanks!

Priority date doesn't apply to immediate family members.

There is no cap on annual visas for these people, so no need to put people in an order to issue visas.

You will have a priority date listed in your NOA1 but it is meaningless.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Priority date for spouses of US citizens is immediate, or the date on the NOA1.

How long it takes to get the interview varies by embassy. Basically how many interviews they can do per day versus how many applicants they have. Then there's the process between the petition approval and before setting up and interview date. Every step has a bit of a wait, depending on the load of the department that must process it.

Whether you consider a Priority date to be immediate or no exist does not really matter, there is no addition wait does.

If I read correctly, you're not waiting for a visa interview -- you're not at that step yet. The wait right now is for the I-130 petition to be approved by USCIS, which will be a while if the petition was received by USCIS on May 6th. You are in the first step of the process. After the petition is approved, the case will move to NVC where they'll process the documents you need to submit for the visa interview. Only after all of that is done will you be waiting for a visa interview to be scheduled. Good luck!
